Topic: H1b Extensions Trump impact - AC21 reinterpretation

When Obama announced immigration rule changes in 2014 there were lots of hopes. Some of us predicted we would get GC soon. Now with the regime change and all these anti desi immigration news sure makes you feel unsecure. My take is nothing can change with rule making, it will need a legislation. With all the midterm elections in 2018, Dems would be back and again the stalemate would start over with Reps in white house and Dems in the Senate.

Beyond the political shade though, what is happening in the market is it is making H1B employers nervous. There are lot of companies that I know have stopped hiring H1B's as full time employees. They are looking for people who do not need any kind of sponsorship and as a last resort hire someone to work as a contractor. There are also talks of jobs moving to offshore/near shore locations.

If Reps want to do something they have a decent chance till 2018 June, beyond that the midterm election fever will start and things will be on a standstill for another 4/8 years.

Looks very good, it is good news going into new year.

What it proposes:

1) Gives I140 portability to retain the PD.
2) Employer cannot revoke the I140 after 180 days
3) Removes 90 days EAD approval and provides an interim EAD if not done within those many days
4) Talks about having 60 days one time grace period if I140 is approved.

a lot more.. but overall very positive.

Overall it does not seem to provide I140 EAD but lets beneficiary maintain non immigration status and port jobs easily.

Topic: Dilemma to take a manager position(Approved I140 as Sr Dev)

I have I140 approved in EB2 for a Sr Programmer skill set with PD Nov 2014. Primarily in Java/J2EE.

I have been offered a Sr Manager role automation (Selenium based) in the same company. In none of prior jobs I had selenium. This is something I learnt on my own to help me with my day to day job activities.

My question is if I take up this new role, do I have to start over with my GC application? and do I have to go to EB3 because none of my prior job skill sets have Selenium?

Do I risk going to EB3 and take up manager position? or do I stick with my current role and wait for EB2 to come through.

I am sure many of you have faced or facing same situation. I would really appreciate your advice on this matter.
