Topic: H1b Transfer Denied after RFE - Urgent

First question - are you with company A, or just seeking an employment with them? If you are not with them no harm no foul. If you already joined them on receipt, you have time to either go back to your ex-employer or find another employer to transfer. Your current H1B denial has no bearing on your future H1 filings. In fact the stance the enw admin has taken is that every filing be treated as if they were filed for the first time. So going by that, your past denials (or lack thereof) shouldn't have an impact on future filings.

Pay stubs are ok in this case. However, if Emp B' H1B filing is denied, and his Emp A H1B has been cancelled (which most employers do, some don't) then he will be out of status retro-actively. If emp A hasn't cancelled the H1, then he can re-join emp A, if they agree.

That's why its never a wise decision to resign without H1 approval.

This "not working for emp A" is confusing. What do you mean by this? The moment you stop receiving pay stubs, you are technically out of status.And I don't understand how this person just joined emp B, but never resigned from Emp A.

Shouldn't affect I485 as long as there is a job offer for the position at the location where PERM was filed. But if you are saying you are permanently relocated, then it could open up a pandora's box (starting PERM from scratch). Check with your legal team.

Yes please do join Company A, but more importantly the H1 transfer need to get approved. If it gets approved, by chance, without extension of stay then you have to leave the country to get visa stamping.
