Topic: Extension of Stay with Passport Expiring

Hi Folks,
I wanted to know if USCIS expects any passport validity for Form i539 (Extension of Stay) application. The scenario is that my daughter's passport is expiring Apr 28, 2018. Her H4 is expired but has i94 stamped till Dec 31st, 2017. She doesn't have her own i797 extension. CBP officer at PoE gave her i94 till end of year based on my i797 approval. I applied for passport renewal but CKGS is not accepting i94 as a document for legal US status. I have reached out to consulate general's office but in the meantime, I was thinking if USCIS would accept the extension application for her (which I anyway have to apply before end of this year) with expiring passport and then I can go for passport renewal with her i797.

Hi, I had an urgent query regarding my daughter's legal status. Her H4 was valid till Sept 23, 2017. We took a short trip to India and came back in July. Based on my i797 approval notice, the officer at PoE gave i94 till Dec 31, 2017. Did we need to apply h4 extension for her. Is she out of status now?

Hi, I have a valid visa from old employer A till Sept 23, 2017. I changed jobs and have an approved i797 with new employer B till Dec 31st, 2017. I plan to travel to India for couple of weeks in June.
1. Do I need to go for re-stamping at the embassy with new employer?
2. My daughter has a valid H4 till Sept 23, 2017. Can she travel back to US on her old visa or would she require re-stamping?

To Jaybash: Was it just extension filing under same employer or it was extension + transfer filing. I think only extension cases can process faster than extension + transfer cases. Was your application transferred to Nebraska Service Center?
