Topic: Potomac Service center processing times

I have question regarding CAP GAP / OPT Extension and H1-B selected petition. Please help me to understand it.
My wife's OPT expires on 30th June. Her H1-B petition has been selected and received receipt. Since her H1-B has been accepted she automatically qualify for CAP GAP and OPT is extended up to 30th Sept from 30th June (because of cap gap).

(1)Now should I file her OPT extension in this case or I should wait until H1-B petition decision.
(2)Can she work with OPT extension receipt (let assume OPT Extension is pending) while her first OPT is finished?

Topic: H.R. 392, Fairness for High Skilled Immigrants Act

Let say HR 392 got 220 cosponsors, then this bill will come to floor directly without consideration of subcommittee? The way it's getting cosponsors we will reach 220 but after reaching number if i has to to wait for subcommittee then what's the point?
I am not clear with legislative process as well as behind the goal of 220.
Can anyone please give idea on it?

Hi everyone, I was going through text of HR 392. Summary make me more confuse.
Can anyone please explain following questions?
(1) Does it really removing per country cap or some percentage of it?
(2) It looks like during transition period (2017,2018,2019) India -China can get maximum 8K GC 25% of 40K & 40K (EB2-EB 3 respectively)
(3) After 2020 and onward we can get max 85%

The bill establishes the following transition period for employment-based second and third preference (EB-2 and EB-3) immigrant visas:

for FY2017, 15% of such visas allotted to natives of countries other than the two countries with the largest aggregate numbers of natives obtaining such visas in FY2011;
for FY2018, 10% of such visas allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2012; and
for FY2019, 10% of such visas allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2015.
The bill sets forth the following per country distribution rules: (1) for transition period visas, not more than 25% of the total number of EB-2 and EB-3 visas for natives of a single country; and (2) for non-transition period visas, not more than 85% of EB-2 and EB-3 visas for natives of a single country.

Amendments made by this bill shall take place as if enacted on September 30, 2016, and shall apply beginning in FY2017.

Topic: Getting new I-94 card at Detroit - Canada Border (by Road)

Hi all,

Can you please guide me with my situation? I know I am asking for lot but it's needed.

My wife entered in USA with H4 VISA on July 2015. Her H4 VISA is valid up to November 2017 and we have stamp for it on her passport.

We changed her status from H4 to F1 VISA in February 2016 for F1 OPT purpose. But college is refusing to provide OPT. So I am planning to bring her back on H4 VISA because I am on H1-B VISA and have I-140 approved. So I can file H4-EAD and she can start working from June. She has job offer to start from June.
Can you please answer following questions?

(1) Does her H4 VISA is voided since she got COS (change of status) in USA?
(2) If 'YES' do I need to file COS F1-H4 again? That will take minimum 4 months according to current processing time. Can;t afford since she will lose job offer. It's better to go out of USA and get H4 stamp directly from consulate.
(3)If No' can she reenter in USA again by travelling to Canada / Mexico / India on H4 VISA which she is holding right now?
(4) If she reenter in USA on H4 VISA, will she get new I-94? After that does she need to file any COS with USCIS or she is good? If it works she can file H4-EAD?
I am open to all other suggestions for your side to get it done fast and safely.

Vamika,

My case was approved on 18th Fab. on 19th Feb they post receipt from USCIS center to me. I received it today 23rd Feb.
Strange thing is I also got someone else H1-B approval receipt with mine one ( one envelope 32 receipts). So must be your receipt has been sent to someone else. Call them and ask for sending it again or in case of urgency tell them you lost receipt but that's not preferable.

I don't see that SR or ombudsmen is working until you have strong supporting case. It looks to me they are working with their own speed. If you have same dates as of me I am sure you will get approval by this week. All other cases around this date are getting approved . So be patient and don't raise any SR or anything. Give it some time. Good luck.

Your receipt date is 9th September. Did you get any response from USCIS since they have assigned your case to officer.
I hope you have approval. please share it. My case date is 24th September. ( My case was transfered to CSC from Vermont on 22nd December).

Yes today I can see more people got approved having August priority date. On DOL website they have posted June 2015 , it looks they are putting more conservative date (any open case with most last month) so people do not complain.

But it looks they will start taking September cases at last week of February.
