The table indicates that EB2-I visa issuance has dropped from 23,997 (FY2011) to 19,726 (FY2012) and then to 17,193 (FY2013). In addition, porting has not slow down. That will give some indication that how the visa issuance will move in future.

Additionally, EB1-I demand has doubled since FY2011 (4,563 to 9,640). WRT 2012, the increase was only 134.

Topic: Bad news for EB2


I do sympathize with eb3 guys waiting a decade in eb3 and I am not against.. these new porters should go behind the line in eb2 rather than cut accross



I will say that porting is fair because this is written in the immigration law, and all porters are following the law. If this porting part of the immigration law is not fair, then all other things are also not fair. And by other things I mean - country quota, country of chargeability and the basic of EB2 - EB3 distinction itself. Why does basic of EB2 - EB3 distinction itself matters? Because it depends on the employer. If it is a small company, it will be more likely to file under EB2, where as a big company will not. Therefore be cool... you will get your GC. FYI - I waited under EB3 for 10+ years, and received GC in Sep.

I doubt that any visa was wasted. Otherwise USCIS would have issued visas till last working day but all visas got consumed by 17th Sep.

Based on visa availability and forward movement of other EB3, except India, I guess PD will move between mid March to mid June 2004 in the last quarter of FY 2014. Once again I am predicting a lateral spillover within EB3 category in FY 2014.

Congratulations to all who received GC, and good luck to all in pipeline. From the demand data - two things are clear. There is a demand of only 2900 visas till end of 2003, and there is an allocation of 2963 visas for EB3 for FY 2014. Thus all with a pd of 2003 and prior will definitely be considered for approval in FY 2014.

It is also true that Mumbai consulate has already published the Visa Bulletin for November, and below is PD for India:

Forget about which is good or which is bad, OCI or visa for the kid. I will suggest that right now, you go for visa on kids US passport. My statement is based on the fact that for minor, you have to get many renewals done for the OCI too. Below is some information on renewal, which will allow you to take a decision that which document is better for you (source: http://forums.immigration.com/showthread.php?29...) :

"In case of issuance of new foreign passport:

OCI registration certificate and �U� visa sticker contain the passport number of the OCI holder. Accordingly, each time a new passport is issued to an OCI holder; it has to be captured on the registration certificate and U visa sticker. This would require re-issuance of OCI registration certificate and U visa sticker each time a new passport is acquired by the applicant in the following cases

�� Up to the completion of 20 years of age, OCI documents have to be re-issued each time a new passport is issued to the holder.

�� Between 21-50 years of age, there is no need to seek re-issuance of OCI documents each time a new passport is issued. However, if the applicant desires, he/she may avail the service for re-issuance of OCI documents.

�� After the completion of 50 years of age, OCI documents have to be re-issued once after issuance of a new passport"

If both PDs are current, the earlier receipt date will get priority. However, USCIS is in the habit of approving the applications randomly, and therefore you can't trust on the rule.

Topic: Green card Revoked and deported

The first thing wrong in the initial post is the fact that someone with GC was deported. By law, the individual have to be allowed to enter US in all conditions and CBP will issue the individual a letter to appear at immigration court for deportation proceedings. CBP can't and will not deport an individual from the airport. The individual can still take up the case with his/her attoreny, and stay back. The OP has not posted complete information.

The second possibility in the above case can be the fact that individual left the US before getting GC, and someone else carried his GC. That can be a direct deportation because individual is returning on an abandoned application.

Topic: Visa for 2013 gone !

1. Take infopass for 5th or 6th of October. Visit the ASC with your spouse, and go along with ticket. They will issue the AP within 24 hours.

2. If the case is approved before spouse departure, you can take the chance, because it will have the issuance date prior to spouse departure. Otherwise don't allow your spouse to travel out for returning using AP. The underlying 485 will be treated as abandoned. In fact if CBP notices the departure date prior to issuance, it's staff may deny the entry on return journey.

They are busy assigning Visa's to pre-adjudicated cases so they don't lose the spillover numbers.....

They have to send out approved EMAIL before 30th of this month to count those adjudication against 2013 quota, otherwise it will count against 2014.

I have a concern on salary because you are going down from 120 to 95. I don't know whether 95 would have satisfied for PERM EB2 employment in your market (place of job) or not. As far as the title concern, I won't bother. And I will advice not to believe on 3rd company AC21, if you can get it going by current employer, which ever it may be. I can go with the advice of not filing AC21, if you want to avoid RFE for salary drop wrt PERM, provided your attorney is confident about job classification and salary as per CODE written in PERM approval.

Recently I received my GC. LC (PERM) was for software engineer, and twich changed title on AC21 submission to Project Manager and Project Manager II (two AC21). Additionally there were salary changes in positive direction up to 92%. The only thing which was not changed was most of the job/function. There was no RFE.

Question is confusing. Are you planning to join a third company, while your EB2 is current? If yes, my advise will be not to join the new company. The reason is that the day USCIS preadjudicated your EB2 application when PD went current in Aug or Sep will be treated as day 1 of 485 filing, and you are suppose to work for 180 days from that day before executing AC21. At least that is my understanding based on my attorney advise.

.... The bottom line is that cases within cut off date Sept 22, 2003 are current and that too till october 31, 2013. So, I am 100% sure all the approvable cases will be approved by end of October......Jayantan

The PD will remain current, and will not retrogress in next few months. USCIS will not issue visas to almost all the pending applicants in October, but will definitely keep the visa issuance at a regular pace.

Topic: Help need... H1 transfer with company B and AC with Company C?

You can transfer H1 to any company but if you get an RFE for Employment Verfication Letter (EVL), then be ready to respond that why you are working with B, when you have intent to work with C. And the act under which the job change is allowed is AC21, not AC1 or AC12.

samnyc! If I am not wrong, the visa is not only to be assigned against a case, but it has to be approved on or before 30th Sep for couniting against FY 2013. One can't assign the visa, and approve in October when FY has changed.

If no new approval is getting reported, then that may be indication of the fact that all visas for FY2013 were consumed.

It is good that approvals are still coming up, and the priority date will remain same in October. If someone is left, s/he will get it in October.
