@PNAGNUR: Good Luck with everything, I am aware how stressful this can be.

To start, You have a H1b right now which makes you Cap exempt (meaning no lottery, just a renewal/extension for H1b whenever your i140 is approved)

Options: Check with your employer if you can work from an off-site location (another office outside the US) or work from your Home country.

If its a yes - work in the US until the last day of your H1b, then you`ll get 10 days to leave the USA. Fly outside USA & Continue working until the PERM, i140 & H1B comes in. Then new stamping and re-enter USA.

If it's a No - You should go to your home country on an Unpaid leave. Take a break & Come back when the PERM, i140 & H1B comes in. The employer might need to wait until you`re back.

I would recommend to stay away from the H4 path for now. Only use it if you`re stuck outside the USA with PERM/i140/H1B issues/audit/rfe.

You should talk to an attorney ASAP and not wait until the last day. Good luck !

Unfortunately Yes - the government shutdown means an unpaid holiday for USCIS and many other services.

This directly translates to more delay for applicants :-(

Topic: What happens to H4 EAD when spouse switches job?

H4 EAD is linked to the H1B.

An employer can revoke an i140 in the first 180 days of its approval. If the H1b holder changes job after the 180 days, there should be no worry for the H4 EAD. (Until the time to renew H1b comes)

To answer your Questions:
1. Can I apply for H4-EAD extension without the prior H4 approval?
--> You will need the H4 Approval copy.

2. If not what are my wife's options - apply for duplicate? Go out of country and get h4 stamp? Others?
--> Apply for duplicate, no need to step out for a H4 stamp (assuming you have some time)

3. In addition I realize there a possibility that H4-EAD it self goes away in February. In that case my wife plans to go back to H1. Is there any issues for this option?
-->Nothing is final if the H4-EAD will be revoked - just rumors at this point;
-->If she has an option of going on H1, they would be a better route ( as you`ll have two H1s in parallel to fall back on each other, incase of job loss) + the EAD might go away anyday if the rumors come true ;-)

Lesson: Gotta scan documents as soon as you get them.

Good Luck - I am in the same boat ! Not sure how it will exactly work.

Are you planning to move out of the country ? work from there ?

I suppose once perm approval is complete, i140 & H1B renewal will be filed when youre outside the country ?and then will be need stamping with new H1B in India ?

Premium processing is an option / not a criteria - as long as someone is ready to pay the extra money :-)

the time on your 6 year H1B expiring soon is a justification to spend the extra money, not a Criteria.

H1B --> H4 (EAD)= Needs filing of COS
Then H4 --> H1B = Needs filing of COS

H1b Will be Cap Exempt (does not need lottery) as H1b was previously approved.

Note: She can continue working on H4 EAD until H1B approval comes in.
