if it is going to be current before thy rescind, then you should raise SR or contact local senate/congressmen to escalate and get the card back in right category.

I know its painful but we need to be very proactive to have this mess fixed ASAP

thats not the right way. If they find out later then it is a big mess and we will be out of status not by our mistake , but they dont care.

You are doing the right thing, we wont get new 485 receipts, everything is going to be the same. We will receive a letter from USCIS that they are rescinding the approval and are we ok with that? Then your attorney has to respond back to that letter saying we are fine with the rescind process and they will rollback the approval and you will get the updates online and final letter as well

hello folks, based on this statement, i took the copy of it and went to local office when they approved my GC when i am not not current. But the officer in Newark said that is not correct and they rescind my approval.

I consulted a very thorough immigration attorney from NYC who is specialized in litigation and he said he can go to court to keep my approval and get the GC, but i was not ready for it :) as i dont want to mess up with USCIS.

So this is bullshit at the end and he needs to findout how to resicnd ASAP

Dear Friends, i am going to India this Friday for vacation and coming back in 3 weeks(8th Dec 2017) using AP. I got medical RFE on my I-485 and my attorney is going to respond this week with the new medicals we got even-though we have time to respond to RFE until 8th Jan 2018. Is it safe to travel on AP while having medical RFE on I-485

i am with EB2 PD March 2009, got RFE last week for Medicals, i am sure this medical is going to expire for sure before i get GC, this is painful as this is my 3rd Medical.

Whats the date they go for expiry, with the day doctor signs and provide the documents.

It's a crap and we ended up in spending more money for this medicals. Not sure i am going to be current in another 1 year where the new medicals i will be sending is going to be useless :)

such a sad thing, they should come an say lets keep this approval and issue the card, but they wont. When i was discussing with an another attorney(specialist on litigation) on my case , he said he can retain this approval with lawsuit against uscis but i wasn't favor in doing that, so kept quiet with their mistake

You wont be having any issues but we cannot travel if there is any emergency, thats the craziness for the mistake that we didnt commit

i am full-time with American company and they took care of all the costs, mostly attorney fees as we didn't re-file anything. Some people go for MTR if it is not a valid approval to make it faster, but from y point of view both are going to be same time

In short we cannot travel outside until you get the clarity, lets say you traveled outside using GC , later they revoke then we are screwed. So dont' travel until you get the clarity from USCIS.

For me when i went to local office for confirmation, they said this approval is legitimate blah blah. But TSC clearly asked me to mail all documents back to them and process is damn slow to roll it back until then my status was in their system was PR

last July when my date was not current ( Feb 2009 PD) my I-485 was approved (just mine not the dependent), got approval notice, card etc , meantime raised SR with USCIS to confirm that and later they told me that it was approved my mistake and they took everything back. It took 6 months to rollback my status from PR to EAD state.

This was a bullshit and nightmare experience to me

yep, that's what i figured as well. But the new offer i am planning to take they are ready to file Supplement J anytime, may be i can ask them to not file right now and do it the time RFE comes and can just do the H1B transfer alone which is already under process
