Stop hyperventilating. In vast majority of cases the card production ordered message appears BEFORE case was approved message. Happened with me too. How much time elapsed between CPO and approved status depends on case to case. So what you saw is TOTALLY normal. Your visa number is allowed on the date your card was ordered which cannot happen if your date was retrogressed.. sometimes it also happens that your case was alloted visa number they sent the RFE, that has also commonly happened with many people.

I agree with you Biomed, and I don't disagree with your argument. I apologize if I came across as looking smug and/or arrogant. Not my intention.

There are only a limited number of visas available and until and unless consumption from both EB2-ROW and EB1-ROW/I/C decreases the chances of spillover are rather limited at best. Last time the increased spillovers were because of recession going on - we cannot depend on a recession to happen every time the backlog increases.

So absent a real legislative solution that envisages an increased number of green card visas, no other solution will help Eb2/3 India people. That's what I meant when I said the numbers of eb2/3 India applicants are way too high. Even the other bills calling for suspension of per country limits will not work because of opposition from other countries.

Also when it is public knowledge why file for the GC when you know how long it will take. Far easier to pack your bags and execute the desire to return home as you say...
When the waits are public knowledge cant you see filing for GC then complaining about something you knew about to begin with is obviously going to fall on deaf ears with the natives right? They will just say 'not heard of google?'



In the mass of comments here you seem to have missed some key pieces of information:

1. From a population of 1B, 200k illegal immigrants is an insignificant number
2. Most of the people who are on these forums came here when the wait for GC was 3-4 years, maximum 5. So no, when these people came they did NOT know that they'll have to wait decades to get the green card.

Now you continue on your India bashing, I'm not gonna participate in that discussion with you.

I only got two documents notarized: change of name affidavit (for name split purposes) and change of appearance/signature form (to verify current appearance and signature). Rest all I self attested. That's what it said in the checklist.

I applied for passport reissue (split of name service) and sent in my application package to CKGS NYC office on Monday using their Fedex label.

Fedex tracking shows it was delivered on Tuesday but till now there are no updates at all on my case when checking my account on the CKGS website. It doesn't even say "received" or "verified".

I tried calling CKGS but they asked me to wait 24-48 hours, but update even 3 days after delivery makes me a bit nervous.

Do you think they could have lost or misplaced my package or is CKGS generally slow with status updates?

I don't understand the problem. Just make a copy of all her EAD/APs and send to them. They are within their rights to ensure that your wife maintained her legal status throughout, so asking for EADs, I797s is OK. She also needs to update her medical so asking for an updated copy of medical is also OK. WHat is problematic is that they're asking for Supplement J. They shouldn't be asking for it because she is applying for derivative adjustment. Suggest writing a cover letter and explaining that they issued the RFE for Supplement J in error, or ask your attorney about it.

All I can think of is that your earlier approval was by mistake, the IO later realized that there were some BC pending and thus he/she stopped the approval process. PS: Just hang in there; once all the requisite BC on your case is done they will approve it.

I do not have the answer to your question. But I can assure you that you'll have difficulty getting reentry on B2. That's why BEFORE doing ANYTHING else and definitely before trying to travel to US, contact a very good lawyer. If you do get denied entry it will most certainly complicate your future immigration efforts. I mentioned a name above, contact that lawyer, or find another good lawyer.

My concerns is that since he has already shown immigrant intent by filing 485 while being on B2 status before, in most likelihood he will be denied entry at the airport. That's why before he does anything he should contact a good lawyer. If he tries to enter US and is denied entry that will further complicate his future CP efforts.
