Topic: July 2017 I-485 filers

Any guesses about when the next Nebraska to NBC transfer may take place? Maybe end of this week?

The published times for interviews at the Field Offices are family-based only, not employment based, so not useful for employment-based applicants.

What's your local office? You should have an interview in 1-3 months.

What did they tell you when you called? My 140 has been approved for over 3 months and I'm still waiting, may call if no movement by Jan 31.

Mine and Dependents I-485 Cases have been updated today after 9 months that Case was received at local office on January 10th . What does it mean? Will Local office ( seems to be Philadelphia) take up my case and schedule interview? Please advise.

Yes, interview. You never got an update that your case was transferred to NBC?

On average it's taking about 1-2 months to get to your local office from NBC, then another 1 month for interview to be scheduled at the Field Office. Congrats on getting such a quick NBC transfer!

Topic: Quitting employer after GC

Most lawyers say you can leave after having worked 6 or more months with sponsoring employer after having received green card, for any reason.

Such BS! You should have heard a long time ago! 3 months from 4/25 is end of July, so you should have had movement in August!!! Maybe try contacting your Congressman

Your application will still be considered having been filed May 30, however you shouldn't expect any movement on your case until it's been about 2-3 months post I-140 approval... so hopefully sometime in March 2018 you will have some movement

You've been waiting almost a year, and your case hasn't even been assigned to an officer?! WTF. I'd contact Congressman to move your case along.

Glad to hear it went well! And no, I don't believe that you need to turn in your I-94 once your green card is approved.

Topic: Impact of Trump's proposed AC21 changes for H1B visa holders

If DHS/USCIS implement the rule to not allow H1b extensions beyond 6 years, this will severely impact Indian/Chinese nationals who are planning on eventually getting a green card in 10+ years time. Like the above poster said, if they've already filed 485 and gotten EAD, then they'll stay on AOS and work under EAD. If only 140 has been approved (or not even filed) then this will lead to a loss of status at the 6th year on H1b, and consequently thousands will have to self-deport (which is the aim) or figure out an alternative status. Very problematic. A class action lawsuit will inevitable arise, but it will all depend on the judges hearing the case, and I predict they may side with DHS/USCIS since in the past, much deference has been given to them to interpret the law as they see fit.

Topic: I485 - Case Was Transferred to NBC

Thanks for that nice info. Unfortunately, I think we will be seeing more and more of this in the coming months, where there will be a backlog in transferring cases from NBC to local field offices as the field offices become swamped... followed by a backlog in transferring cases from Nebraska/Texas to NBC as NBC becomes swamped...
