The current PERM count for EB India in 2009 is 11K+. Are you saying 1/2 of them were porters and hence 12K incl. dependents? I would expect that the nos. would at least be around 9K who are waiting in line which means we have 18K AOS at least

While we do not have facts to prove anything people can only hope (false or not). This 60K could have several combinations:

a. People who went for an EB3-EB2 upgrade (these are people who have a PD in 2007 or 2008 or 09)
b. People changing jobs (priority in 2010 and then moving in 2011) and hence duplicates
c. Spouse and Self having their own applications
d. People who could have come back on EB1
e. I do not see a lot of people who could have left the country but again let us take them as well

These numbers could be significant or not. I would typically keep them around the 30K mark as you said and go from there. With decent spillovers in the next 2 - 3 yrs, we should see some good movement. On average the no. of EB2 and EB3 who are GC holders are around 16-17K mark I presume for the past 2 - 3 yrs and definitely this year it will be more with the spillover.

We also need to count the fact that Philippines have progressed significantly on their EB3 dates and so does China. So with all in and a tough immigration regime until 2020 at least, things should be good. If Trump wins again (which I do not think) in 2020, it may not be impossible to arrive at that dates by 2025 as Aceman suggests.

I for one, would not want to deter people from at least hoping as that would keep them going further. So let us all wish ourselves good luck towards this GC journey

Unless USCIS starts to accept filing dates, you cannot apply for I-485 yet. Wait until next bulletin or see what uscis will accept (final action dates or filing dates)

There are no consequences but it does put your wife and the company she works for in trouble if they audit out.. Until you get your EAD, the person should not be working if the prev. EAD has expired

I have couple of reliable TCS friends and have been told by them as well that they don't do GCs so easily on EB1 and the ones they do are on a limited basis. L1A does not imply that they do GCs for them

I understand the need to be prepared but it is also amazing how one bulletin changes people's perception and raise hope. We are already talking of whether to do EB-2 or EB-3 for people in 2010, 2011 etc. when the dates have not even reached 2009 for EB3I. Are we safely assuming that no EB-3I exists post July 2007? I also think that there are definitely people who are sitting on EB3I with priority date beyond July 2007 but never ported. It would take at least another month or two to gauge the movement and would recommend people making their plans of whether porting from EB-3 to EB-2 makes sense or not. Until then it is wait and watch.

As some of them pointed out it all depends on the motivation of the CO. If the CO is really intent on not wasting I hope he moves the numbers to a decent number which can be around end of 2009 for both EB3 and EB2. This would at least limit porting and use as much as possible. Sadly he never does citing his ignorance and lack of visibility into the future. Hope we are all proved wrong in that sense

When EB1 dates are in 2012 (at least for India and China), the spill over should not get applied for this year unless the dates for EB1 moves.. I feel USCIS was smart that way to gauge and move demands.

His wife does not have to file PERM or I-140. All that matter is she should be on H4 or L-2 depending on your friend's status and they can use cross chargeability to file AOS. Ask your friend to take help from his or her attorney than friends and they should be able to provide them with the docs.

Honestly I do not know which of those PIs are to be even trusted. If you look at April 2017 PI, then the last 2 seem to be much closer to it than the August 2017. Either way I do not know if they even look at any of these to judge on the visa bulletin. It is amazing how organizations are so disjointed that they decide to put some dates in the bulletin. Maybe all they care about is shooting some dates. All we have is these PI so less litigation if they keep letting people second guess based out of it. And if their software is debunk good luck for everyone of us in line

South Korea does not consume as much in EB1 or EB3 and hence you see that their EB2 allocations are higher because in total they are still within their 7%
