The formula is not as simple as just give the remaining EB3 visas to EB3I. Philippines get it because they don't consume as much in EB-1 and 2. So they get them in EB-3. There is vertical spillover amongst countries as well to reach the 7% allocation. For e.g. India, once they use their 7% allocation do not get spillovers until other countries that have not reached their 7% have got their allocation.

It is not free ride.. Of course if things don't work they will cough up that money for the education. And why do you claim that the kid was out of state? Of course he is residing and they pay taxes (through their parents). Question here is why the immigration status becomes the point of contention.

People continue to fight for such causes and I am sure no one is going to say no and start paying even if they don't have to.

While I do not agree with the language and angst that people seem to exchange in these forums, let us not assume that only Indians bash amongst ourselves. Many other countries do.. Maybe it is more in our culture that we make it quite openly and not subtly. That is the big difference. We were more tolerant in our own country and we have moved to this country expecting things would be better. Now that we are stuck, frustration creeps in and people are venting it in different forms.

I have to agree that blaming Dems alone for siding with Latinos has no logic. Republicans have both the houses and still are okay with giving the illegals a breather while nothing for the legals. So why blame Dems alone here? Rs are to be blamed more. But also I am not sure whether Trump is going to keep his word on DACA. He is always incoherent. It all depends on which side of the bed he wakes up that day

EB1A and EB1B mostly require extraordinary ability in the field which is typically filled by researchers or sports people with exceptional talent. Neither of these take in VPs or AVPs as these are not considered exception ability. Of course if you can convince the USCIS that you are the worlds best VP or AVP via papers or citations you can get it but this is not the norm within the qualifications set forth in EB1A or EB1B.

EB1C is a possible option but only if you have worked on a similar executive position outside the country for a year in the same company (it cannot be a different org). These are referred to as multi national managers or executives. If you have directly joined the company in the US as manager and grown to be a VP or AVP and have never worked in a managerial capacity of your organization outside the US you will not qualify under this category. There are several people who have gone back (say to India or Canada) and comeback as a manager again and use this route successfully. Hope this helps to an extent. Good luck

While that is true, the H4-EADs that are approved could have the same person applying for H4-EAD again when the current EAD expires. So that number in total is pretty convoluted and is probably only meant to provide no. of EADs that DT asked earlier to be provided every quarter or so.

Exactly. People want to assume that only they are here legally and with no abuse. If EB-1 is to be made stringent (esp. EB1-C) then EB-2 and EB-3 will be in far worse scenario and never see a GC in their lives

Topic: Oppose DACA for all its worth!

I am with you on this.. Not to put down the efforts of fellow desis who are putting their heart out, but getting people to come out of their homes and doing protests is not easy.. There are several other priorities at home people have to work on that simply does not lend time and follow up. For people who are doing it I salute them.

Secondly, this is what I told my older son who is born in India. US GC or Citizenship is not the end of the road. There is life outside USA and he can still work and be successful outside this country. At the moment, take the education and opportunities that this country offers and utilize it for his betterment. My wife and I are not even sure if we will continue to live here after their college and we shall take it as it comes.

USCIS is only accepting final action dates at the moment for EB2. It will become current for ROW in October and you can file then. Your lawyer is correct

I think Murthy has worded as conveniently as he can and 1 year might be his best case. Also, all these dates for EB2-I depend on the porting factor as well. Given the state EB3I had been all these years porting made sense. But if the dates for EB3I moved as fast as it has been this year it may also make people in EB3 think about porting if their dates are pretty close. Of course CO or anyone may not have this visibility so the predictions are based on current situation.

The cutover is to stop anymore EB1 approvals for India and China until end of the year and to keep visa under limits. It will come back to Current in the new fiscal year.

The way it is done now, yes. The advantage is for people who even travel within the country though because it has TSA Pre inbuilt in which case it has a good benefit. If they can ensure that the Passport verification can be done at the Indian consulate it greatly benefits us. Else yes, it is useless.

Are they on EAD or H4 visa. If you have filed AOS (I-485) then, there shouldn't be a problem because each applicant on the I-485 can be on their own. I guess you meant you are not using your EAD but still H-1 and this is perfectly fine. They can use their EADs. The key is filing AOS for everyone. If no I-485 was filed, only your spouse can work based on H4-EAD and your child cannot as H-4 EAD is applicable only for spouses.
