Topic: I 140 Revoked, Have an approved H1b for 3 years need stamping.
Hi
I had an I 140 approved from a previous employer which was revoked by my previous employer for leaving the company.
My new employer(FTE-Client) have a H1b that is approved for 3 years based on my previous I 140.No Perm Filed yet..
Now I am required to travel to China for my company.
Will I have any issues during stamping. I have the approved(now revoked) I 140 copy.
Please let me if any one had the same situation, I am sure a lot of people were in the same boat.

As per the premium processing, if they charge you 1225, they will process RFE as premium as long as the petition is filed before May 26th. |

When you say full time are you at a client or a consulting firm?
Either ways Travel only after the H1b is approved. |

but it does not say anything about the new temporary rule.
I am hoping change of employer does not fall under that rule

1A) It would take maximum 1 week, did you pay for premium processing? if yes then check your account for fees deduction and follow up with attorney/employer.
2A) This case both are the same and the rule will apply.
3A)Are applying using the same client project for the H1 extension if yes, Then I would say NO. |

Hi,
As long as you have a receipt number before May 26th your case should be processed under premium.
As per my discussion with other attorney on other forms they say that if you have receipt number before May 26th your will continue to get premium processing even after May26th as as long as they act on your case with the 15 day period.
I am not an attorney I am just saying you what I read.

The h1b processing under premium will be temporarily suspended until July 27th 2015.
My application is submitted on May 15th under premium processing at California center. I also received a case number.
As per USCIS link.
"USCIS will refund the premium processing fee if:
A petitioner filed H-1B petitions prior to May 26, 2015, using the premium processing service, and
USCIS did not act on the case within the 15-calendar-day period."
What does it mean by "USCIS did not act on the case within the 15-calendar-day period"
I have a case number so does it mean that USCIS have acted on my cases?
If I get a RFE will the USCIS still process my H1b using premium processing?
Please help with your expert advice

One of my friend came to US on F1 and applied for H1b in 2013 and his Application was picked in the lottery.
He got an RFE for his H1b and was rejected because his employer did not respond to the RFE Promptly and with proper documentation.
The question is can he apply for H1b as a cap exempt or he need to go through lottery again. Please respond with suggestions |

Hi Gurus,
Here is my situation.
I moved to a new employer last year since my previous employer messed up my GC processing.
Got My I140 approved with my new employer and filed for H1b extension and got an RFE (Employer Employee- Right to control) for my H1b extension.
My Employer has a direct client.
We have the following.
Client letter from November.
MSA
Copy of H1b Support Letter from my employer.
Employment Offer letter
Itinerary of Services
Copy of Position description.
Paystubs.
The RFE is asking for
-SOW- my employer got the SOW.
-Previous year employee review- We have the review
-Organization chart- We have the Org chat.
My concern is do we need and updated Client letter and PO or we should be o.k with what we have.
Please let me know if PO and updated client letter is mandatory.

I would suggest not to change because of the fact there are lot of people getting PERM audits and I 140 audits ,if such thing happens you will be trouble and its taking close to 5 months just for the PERM process.
So its your call.. |

I am not sure if i am reading it correctly the stats say that the Job posting date is 07/07/2014 and approved on the same date? this is a bit confusing for me. Keep up the good work this is encouraging.
