Topic: Jan 2017 I-485 Filers

I am here to add little details for other users who raised SR and receive 60 days wait response. My SR response raised on around mid of December was "to wait for 60 days" and I did receive updated in few weeks from that. So keep faith, receiving response to wait for X days is way better than getting stuck in background check. Good luck to you all.

Thank you guys. All of you three guys have very close date to mine. My was even lower category ( eb3). I would still like to suggest you guys to raise SR if you have not raised it previously . I strongly believe that both my i-140 and i-485 was pushed by SR.

So I believe that is approval as we did not apply for any EADs. Details on profile.

I totally forgot that you can not raise any SR on i-140. My bad.
Have you registered in USCIS official website ? It does show you the history of your application. You can add your i-140 as well in there. Though my lawyer raised my SR , I was able to see the history of when was SR raised and when the response was sent. I can still see the list in my case . Try it there, it is better than nothing.

If you are talking abou SR response , it usually takes around 15 days till your lawyer gets response. The best way to track SR status is to create USCIS account https://egov.uscis.gov/casestatus/disp... ( if you don't have any ) and add your i-140 case number in that account. If you click that case number , it will open the current status of your i-140 . And below it, you will see all the history by yourself, including your SR status almost real time. Like these :

On November dd,yyyy , your inquiry about why your case is taking longer than our processing time, referral number SR***TSC, was completed.
On November dd,yyyy, we sent a response to your inquiry about why your case is taking longer than our processing time, referral number SR***TSC
On November dd,yyyy, your inquiry about why your case is taking longer than our processing time, referral number SR***TSC
, was assigned to an officer for response.

Based on previous discussion in this same thread, you are very likely to get decision on your application within a week or two.

thanks.
My case status just changed last night. Receieved email and mobile alerts for it and went to uscis site to verify. I have yet to receive the confirmation in mail. So basically, it was updated accurately and in realtime, unlike jkhan's.

If your i-485 is rejected, most PROBABLY your AP terminates with it . But as long as you maintain your h1b, you can go to stamping anytime. Make sure you carry all the docs needed for it when you travel.

You just need to show your AP and passport to the immigration official. They are aware of it, no explanation needed.

My POE was DFW , Dallas, TX. But I do not think it is relevant as I came from Doha which has pre-clearance. Basically what it means is , all the immigration and custom declaration are taken care at Doha itself by US immigration officials ( was in 3 hrs line ) before boarding the plane. My arrived date on US is the date I boarded plane on Doha, not the date I landed in Dallas. In Dallas, there was no immigration at all. I was in local transit, not international transit basically.

I had my h1b till 2019 as well. But instead of getting into hassle of stamping , I chose to go hassle free way. And for h1b stamping, there was few months of wait in our country and I was in need of immediate travel. But h1b stamping was defintely my last option to go for.
If you have all the documents needed for h1b I don't see any issue on stamping . But still, getting your AP copy would be more easier and less painful in my opinion.
Since you are about to leave before getting the copy, just wanted to make sure it is not some kind of emergency. If this is kind of emergency , you can go to field office and get your AP right there on same day.

I traveled on AP ( Not India, but neighbor) . My i-140 and 485 are still pending. It seems like all travelers with AP will be taken to secondary inspection room. The officer called me about 10 minutes later. Asked me if I was carrying big amount of cash. That was it.
So , it took me 10 minutes more than average travelers.
I was traveling through one of the pre-clearance transits.

For me , the major issue was to convince the employee at airport in my country that the AP I had was valid travelers document that permits me to enter USA. My was emergency AP so it was printed in A4 papers. It was kind of distressing at my country's airport to get checked in.

The second part you mentioned about i-140 and i-485 SR is absolutely true. I confirmed this with my lawyer. For i-140, it is application filed by `employer on our behalf`. So it belongs to employer, not us. So we are beneficiary, not applicant .

from may of 2016, I believe that is very long time. Most of us here are from after nov/dec of 2016.
I am not saying there are none, but I believe there are very few from that time line. If possible, try to contact ombudsman , that might get you to some end.
