1) It doesn't matter what experience you have. What matter's is the experience required for the position. Looks like in this case your employer has the requirements as Master's = 0. Based on that requirement, you qualify for the position. You will need to submit experience letters at the I-140 stage.

2)Not an issue. You basically have to be paid at least the prevailing wage, so anything more is ok. Is there a difference between wage offered and prevailing wage?

Because then the employee is not dependent on the employer and can change jobs any time

i for one am not whining here.....i am trying to get everyones attention on the root cause of the issue.

Everyone seems to be blaming US Govt as the evil empire who wants to treat desis like slaves by not giving them GC on time....i am trying to show the root cause of the issue here. Our own indian companies abusing both the US Govt and also fellow desis...

I am going to do my part and tweet/email/talk to local senators & GOP presidential candidates about H1b visa abuse and EB1C abuse...



The person 'logicaldesi' not only whines all over these threads, but unlike his id, usually has the most illogical things to say. He is all over the place and things that he says are incoherent. Yesterday he was blaming IV for everything, then called me an Amway rep, then was talking about an example of how the Groupon CEO resigned. When asked what has he done except whining, the response was " i am not obligated to do anything"


Stereotypical whiner - someone that feels that he/she is not obligated to do anything but blames everything apart from himself / herself for their plight.

Yes. PERM can be started irrespective of what visa you are on. You don't even have to be in the country. PERM is for a future job.

Have you participated? Have you joined a State Chapter or been to a DC advocacy event? Those are open to all.

Everyone has great ideas, but no one wants to come out from behind their computer - but yet you want elections and a board - wonderful! What else? Do you want IV to overnight a Green Card to you as well?

The old attorney is still liable for the PERM. Have your employer contact them and get both attorneys on the phone in a conference call and ask them to sort it out and think of best course of action. Even if the old attorney wants to charge for a consultation, go for it. Tell your employer this impacts your career and future life and you want the employer to take care of this. See what comes out of this.

See if you can extend your H1-B based on Approved PERM pending > 1 year
H4-EAD is actually a great option. You can get on H4-EAD, and restart the PERM process, should take 18-24 months (just that this time you can make sure that everything is carefully done)

Its pretty sad that this is how most employers and lawyers treat employees. Both are making money off the beneficiary here yet treat this process like their lowest priority.
