Do not exhaust the 6years of your H1B. Keep few days and leave US before that. Not sure what happens if you exhaust it but generally people don't exhaust it. Just leave early and avoid issues

if you get the PERM (hard copy) by 1st May go for premium I140 and then by 16th May when I140 is approved go for H1B extension.
If this doesn't happen...exit US by 20th May and wait in India for PERM approval and i140 (premium) approval and the h1b extension (premium) and stamping, then only you can return

One question here,
My H1B is valid till 4th March 2018 and there is no time for recapture. Hence the I94 which I have in the approval notice is valid till 14th March 2018 i.e. 4th March +10 days.
I am planning to exit US as I don’t want to exhaust my H1B, so that I can wait in India for getting my PERM+I140 approved and then file a 3 years extension for my H1B and re-enter.

Now the question is when should I exit US depending on the dates I mentioned above ? I am planning to exit on 1st March 2018, do you think it would be too late as I don’t want to impact my 3 years extension.

Thanks :) thats explains a lot.
But lets say if a go to India for 3 weeks in January. Then i guess i can file a H1B extension on 3rd March to extend my Visa to recapture the time? The decision for this will take 2-3 months and till that time i can get my i140 and file another extension for 3 years?

Hi,
My H1B will expire in coming 4 months (no recapture time remaining) i.e. 14th March 2018. My PERM will be filed in few days, looking at the current processing time it seems like it takes 4 months to get PERM approved and other 4 weeks (getting hard copy of perm + processing time) for I140 under Premium.
So, the issue is that i can extend my Visa for 3 years once i get my I140 but that would take 5 more months but my current H1B will exhaust in 4 months :(

One easy way is that i leave US just before my H1 expires and then wait in India to get I140 (under PP) and do H1 extension (under PP) and then get it stamped and return back.

But just want to check if there are any ways if i can stay here without going back by filing an extension few days before H1B expiry, let's say on 3th March 2018 (even though i MIGHT not have PERM/I140 and no time for recapture) and then wait for PERM/I140 and once they are approved then provide the approved I140 to the extension papers.

Will this cause a Visa overstay? i.e. filing an extension on 3rd March when my H1 is expiring on 14th March and then providing the I140 in May hoping that the H1b extension papers do not reach the hands of Visa officer by May.
