Topic: Taking sabbatical on H1b

Hi,
My wife's H1B is valid until Sept 2018 and she intends to stay home (not travelling outside US) with our son for next 4-5 months. I was wondering if anyone knows whether taking sabbatical/extend leave without pay on H1B is allowed or not? I know her company's HR can provide more information but any input from you guys would be helpful.

Topic: H1b amendment processing time?

My amendment got approved today (May 10th)! It was with Vermont. They had received my case on August 16th 2015. Almost after 9 months.

Topic: H1b amendment processing time?

As per USCIS website, "Field Office Processing Dates for Vermont Service Center as of: February 29, 2016" for H1B Amendment (I am assuming it falls under "H-1B - Specialty occupation - Extension of stay in the U.S") is July 20th.
Does this mean as of today they are still processing cases received by July 20th? The update is always 45-50 days behind the current date. I wish it was updated more frequent.

My fear is that it might take longer starting next week as USCIS will be inundated with new H1B applications for FY2017.

Topic: H1b amendment processing time?

Premium Processing is allowed for H1B amendment. I got it done for my wife last Dec (though we had bear the cost of PP due to company's policy). It got approved within 8 days.

As for stamping, there have been some posts on this forum where some of our friends stated that their immigration teams said it is OK to go to India and get stamping done with amendment still under process. Their immigration teams said that there were some changes made recently in this regards, hence, stamping can be done without approved amendment.
Few of us inquired about this change with our respective immigration teams and they were unaware of this development, and told us not to travel to India for stamping.

There is some ambiguity in regards to stamping, however, most agree that wait until your amendment is approved and then make travel plans for stamping. I guess wise thing to do is follow your immigration team's instructions and take steps accordingly.

My immigration team told me the exact same thing. Unless there is any official word from USCIS, they will not make this official. They said travelling to India for stamping without approved amendment would be at our own risk. I now see few folks posting that their respective attorneys have confirmed that stamping can be done with amendment still under process. I would really appreciate if they can ask their attorneys the source of this recent change. If they can refer us to some legitimate document/link containing this information, soo many of us waiting to go to India (and get stamping) can benefit from this change.

Since you mentioned that this change occurred last week, I am kind of curious to know where your immigration team acquired this information from. I spoke to my attorney and she had no clue about this change :(. There are many folks (including myself) in my company who need to get stamping done but waiting for their H1B amendment approval. Attorney said she cannot make it official unless this change is posted on USCIS website. I wish I could point my attorney to the same source where your immigration team obtained this latest info from.

Hey Shailendra, I spoke to my attorney and she is not aware of this change for stamping. Did your attorney confirm this or you read this somewhere on USCIS website? If yes, can you please share the link with us.

Just trying to get more information what happened in your/others situation.

Topic: Multiple 221g/Administrative processing

Hi,
I am planning to go to Mumbai consulate for H1B stamping next month. This would be my 3rd H1 stamping (7th year on H1B starting sept 30th). Last time (Aug 2011) at Delhi consulate when I went for visa interview, I recevied pink slip. After 5 weeks I recieved the visa with "Clearance Received" annotation. My question is, what are the chances of getting 221g again this time? I work for an Electronic Medical Records company.
Does anyone know of cases where 221g was issued second time or people who received it 1st time didn't get it next time?
Any information would be helpful
