Topic: Adding spouse to pending application.

Is this really correct?? I am in a similar situation, my PD is May '16, got married in Jun '17, filed wife's i485 in Oct '17.

I was under the impression that her PD will be Oct '17, confirmed with couple people too. But given what you said, it appears that her PD will be May '16 as well. This is really interesting if this is correct.

How do I verify this with USCIS? Can I just call the helpline and verify this? Her 485 does show PD as Oct '17, since it was filed then. And her EAD was also filed during that time, so does it apply to EAD as well?

Finally got the new card being produced email/SMS. Thank you everyone on this forum. I have updated my case on the tracker. Somehow, I actually got my medical RFE before Oct 1. My case was approved in less than a week after submitting the new medicals. Good luck to everyone here!

Awesome, thank you!!

I got way late applying for my EAD extension and the new automatic extension rule saved me. Awaiting the new card.

Cheers!

Thank you for the info.

I know that for my 485 I will get RFE for medicals, any other surprises I can expect? Is it fair to say that they won't challenge me with that whole org char/technical RFE now?

Thank you, Sir!

And yes, it should read 03 May, 2016. Sorry about that.

I know 485s won't be touched before Oct, does anyone know a general timeline for approval to go by? Trying to line up certain things, it will good to have an approximate idea.

Thank you, Sir! I remember our priority date is close by, good to hear from you again.

So they did change the rule on Jan 17, 2017. I am so glad that I didn't send the email back, would have made a fool out of myself. Did you get your renewed EAD/AP card?

I can't find any official link saying a person is not authorized to work if the EAD has expired, and they haven't received their renewed card. So I don't have any official link to send back to the law firm (which happens to one the biggest here and I can't believe they don't know what the rules are). I just found this link of muthy.com which is from 2013.

https://www.murthy.com/2013/10/21/employment-aut...

Has this rule really changed? Last time I checked, you were not legally allowed to work if the current EAD expired and you still haven't received the renewed card.

So I got a response from the law firm saying as long as my EAD renewal is filed before its expiration date, my work authorization will be automatically extended while the EAD renewal is in process.

Is this really correct? I thought this applies only for visa renewals and not EAD?

Thanks ssdesign and maniktricks for the response.

I would still have about 10 months or so if not more before I max out. Instead of fighting anymore, I sent an email back to my internal counsel and law firm posing the EAD question. I am sure the response would be that it will be illegal for me to work here post my current EAD expiry date if I don't get my renewed card before. I am going to press on this one point, and hopefully have them file the L1 extension.

My only concern (and a big one) is what you mentioned in your post about adverse impact to my i140 if the L extension is denied. So is it worth the risk? Or should I just move to EAD post my L1 expiry on Apr 30?

My EAD expiry is June 22. Extension will be filed this week, so there is a chance I might get it before that date.

My GC PD is May 2, I am hoping that my i-140 will be approved within next three months. Any idea on how long will it take for AOS and to receive physical card?

Topic: EB1C - Nebraska Service Center

Hey guys, need some advice.

My GC is filed in EB1C and I am currently on L1A, which is expiring end of April. My company is not willing to do the L extension since I already have EAD. The reason I want to be on visa for as long as possible is because it will enable my (would-be) spouse to enter as L dependent and then I can interfile her application. (*I am aware that if I get my GC, she will have to wait for a very long time before she can enter the US. Due to a personal situation we had to hold off on everything).

I am trying to fight for my L1A extension. Does anyone know if the L1A extension denial can have an adverse impact on the pending i-140?
Also, my EAD is set to expire in June. Is it true that if go on EAD post L1A expiry in April, and I don't get my new EAD card before June, I won't be authorized to work once the current EAD expires?

Topic: Adding spouse to Green Card application

Couple follow up questions:
1) If she enters on L2, do I just need to file another i-485 for her? And will we get the GC at the same time or will she have a different priority date (date of filing of her i-485)?
2) Can she be added to my GC application once we are married and if she's still in India?
3) If she has to be here, once we marry, can she come here on her existing B1/B2, and then we file for CoS to L2, followed by i-485 filling? Just trying to understand what would be the fastest legal way

Really? So any EB1C applicant posting on this site is a potential case of fraud? You didn't get EB1, get over it.

Also, she already has a B1 visa. Does that help in any way in this situation? (In the sense if I get the GC before we are able to add her to my i-485 application?
