There was or is no FIFO once the dates are current.

EAD's are taking 5-6 months these days. Factor that in any plans you have.

May be they approved too early. Your PD is not yet current, and its current starting Feb.

Topic: Fired on H1- How to utilize the company provided flight ticket

I dont think you will be able to do anything with it. Any tickets booked through agents have to be adjusted/cancelled through them as far as I know. The refund goes to them and not you. Others, feel free to correct me if I am wrong.

Topic: PD current, Expired Medical no RFE

There are plenty of folks here who have been current for more than a month and still haven't received RFE. So just hang in there. USCIS is very slow these days and it may take a month or two before we get RFE for cases becoming current from feb.

Topic: Dependent has to be in US for EAD/AP

Yes. When you apply for AP, it explicitely says the dependent have to be here. Also AP is getting denied when they find they you have left the country. So stay in the country from application to approval.

Topic: Visa stamping: Quick question

The other response is right. Take it in India as a back up but most likely the pic taken at the visa center will be the one used.

Topic: Cognizant not filing H4EAD ?

There is no requirement for employer to file h4 oe h4ead. Even if they do, there is no requirement for them to pay for it. So there is nothing wrong here.

Topic: EB2 PD 2008 India - updates

Once the dates are current, it really doesnt matter who filed first. It app depend on whos desk your case ends up in and how quick they are in processing your case. There is no pattern to how uscis works.

Topic: Offtopic: Carrying multiple cell phones to India

I am assuming you will also take your own phone. That makes it 4 phones. And if they are new and they find it in scan, they will ask you to pay customs duty.

Topic: EB2 PD 2008 India - updates

Did you reach out to the ombudsman office? https://www.dhs.gov/case-assistance They usually are backlogged and may take a month or two to look at your case. I would say, submit a request and then wait for it to be picked up. If your case moves forward before that, even better.

Topic: EB2 PD 2008 India - updates

Hmm!. I got medicals once and two other rfe for other employment documents. Fed up on spending money on RFE. I'd rather wait and het it once and respond and be done with it.

Topic: H4 EAD or H1B which is valid

The last approval is what you should look at. Why would you even apply for h4 when you have a h1b pending. She is now on h1b. I'd say that's a good options with everything going on with h4ead.

Topic: Opt extension denied; H1 denied; Options

If you are no longer on F1, then you have to switch to h4. Since your h1b was denied, and if your F1 got denied earlier, you will be considered out of status for the gap period. So even if you apply for H4, you may not get I-94. I would just recommend leaving the country and getting h4 stamped. It's easier and quick.

You can't get I-120 anytime you want. Even if you manage to get, you could still be considered out of status and may have to leave the country anyway.

I would recommend h4 for now.

Topic: EB2 PD 2008 India - updates

I believe Supp J needs multiple party signatures which probably delays things. IF we are working for bigger organizations, it could take time. I work for one, and I would be happy if I can wrap up things in 2 weeks. Waiting for the RFE.
