Dear Friends, Finally my I-140 (EB2) has been approved. Just received a note from an attorney TODAY (3/6/2017) that they have received my approval notice.

USCIS Received Date: 07 Sep 2016
USCIS Notice Date: 09 Sep 2016
Processing Type: regular processing
Approval Date: 23 Feb 2017

The status in USCIS is still showing as "My Case Received", it has not been updated.

Yes I have recaptured all my time and no 7th yr extn. I just wanted to know incase if my decision gets beyond Sept 30th, in that case can I still continue to stay until the decision?

Dear friends, Currently MY H1-B VISA expired and my employer has applied for an extension and which will come untill end of Sept 30th and will complete my 6yrs. My Extension got a RFE and my employer is responding for RFE this week.

Can I continue to stay until my decision has come?

So my understanding is that to apply for I-140 after PERM APPROVAL, I dont have to be in this country and my Company can proceed further.

Do you think it is always better to keep some buffer time rather than utilizing full 6yrs?

I have to leave the country as my 6yrs H1 max out by Sep-08-2012. I'm sure before that date my PERM will not approved. My company HR saying that "we will file I-140 in PP after PERM approval and then 3yrs H1 Extn in PP, after that you can go to Visa stamping in India".

But is that true that I don't have to be in this country for 140 filing.
