Lots of companies does not hire h1bs, changing a job is not easy. You cannot go to India, because of the fear of not getting visa stamped or most of time your visa extension is pending... Yes, lots of other contries does not have so many engineer's. How do u know that they are not fraud. Every one does the same thing... Because of the population and proposition Indians are highlighted.

To greater interest when you have a GC such employers like tcs, CTS doesn't expliot. Jobs are not given based on country of birth, but they are mainly for talent. EB category is for employment based, then why the system making it as country based?

I dont know how many of us contributed funds to IV.
I did not, and no one ever insisted me to donate funds. Some of the guys are doing this with out expecting any funds and with the intent of helping backlog community. Lets admire their effort, if we cannot then atleast dont discourage them.

WITCHES are encouraging L1As now. Recently many people are getting L1A visa and when they land here, with in 6 months they apply for EB1. Please stop L1A abuse.... drastically this help in reducing EB1 abuse.

L1A manager working at client site does not really have hire and fire authority. They just manages the project and full fill the resource requirement from client. If client say there is not budget, they release the resources. They does not manage organization, or a department, subdivision, function, or component of the organization, anything they manage is a client’s project and programs. Clients controls the funds projects resource allocation and release. Any one working at the client location should not be eligible for this.

There is not salary requirement for these L1A manager. Most of these L1A managers gets lesser salary than H1B managers.

There is a recent executive order about, H1B abuse where American Citizens are being replaced by low wage H1B candidates. The worst thing happening now here is H1B candidates are being displaced with no wage requirement L1B candidates who are paid lesser than H1B candidates.
Such L1A frauds cases are also auto eligible for EB1C.

I am working in one of the WITCHES,,,, I see the trend.. there is a scrutiny on H1Bs and L1Bs, but L1A are getting sponsored in a big number. And some one working at the client site and reporting to Client manager cannot take this L1A role.

H1 was meant for bring more workforce when the demand is more than supply. In some cases there are H1B abuse but there is high magnitude abuse in L1A and L1B.

Almost around 90%+ of the applications from consulting/offshoring companies like Wipro, Infosys, TCS, Cognizant, HCL, Syntel (WITCHES) abuse L1A and L1B visa. Here are some of the pointers.

L1B:
When they work at the client site none of these companies uses organization’s product, service, research, equipment, techniques, and management. They follow the client product, service, research, equipment, techniques, and management. In 99% when someone works at client site they are not eligible for L1B.

Abuser is not the individual (WITCH manager), it’s an organization like WITCHES and victims are not us but it is USCIS and DHS who are been cheated by these organizations. The intent from USCIS was to bring and retain the good talent who can grow or help in building American economy. But the rules are loosely defined and loop holes are misused by companies like TCS, INFOSYS, Cognizant, Wipro, and Accenture. There is certain rule defined for H1B but there are so many loopholes for L1A and L1B.

Here are the eligibility requirement of L1B and L1A.

L1B:
Specialized knowledge means either special knowledge possessed by an individual of the petitioning organization’s product, service, research, equipment, techniques, management, or other interests and its application in international markets, or an advanced level of knowledge or expertise in the organization’s processes and procedures.

L1A:
Executive capacity generally refers to the employee’s ability to make decisions of wide latitude without much oversight.
Managerial capacity generally refers to the ability of the employee to supervise and control the work of professional employees and to manage the organization, or a department, subdivision, function, or component of the organization. It may also refer to the employee’s ability to manage an essential function of the organization at a high level, without direct supervision of others.
