Topic: Effect of govt shut down on immigration

they're already working to see if they can bring in 3 weeks of funding by Monday. last time tho it lasted 3-4 weeks i think. problem is not the shutdown in itself...its when they restart work - it takes a while for the wheels to come back to full spin...so there's a post "restart" drag effect that keeps things slow till everything returns to normal.

I din;t think BC will stop RFE. Did you ever get any RFE in between?

Never. Not once.

Topic: EB2 PD 2008 India - updates

I believe Supp J needs multiple party signatures which probably delays things. IF we are working for bigger organizations, it could take time. I work for one, and I would be happy if I can wrap up things in 2 weeks. Waiting for the RFE.

You will probably get the RFE quickly - was looking at all these cases with got RFE. My ED is Nov end 2016..seen RFEs for cases fi with RDs in Oct 2016...RDs prior to that should get the RFE almost immediately after becoming current. Though I'm not 100% certain if this is the proper reason for why some of us who are currrent haven't yet got the RFE. Can BC check prevent even sending out RFEs or does BC check kick in AFTER one submits RFEs?

Topic: Effect of govt shut down on immigration

Looks like anything to do with PERM and LCA will get put on hold. Other adjudications shouldnt be affected. I assume "Filed and pending applications will not be processed" implies both of these are stuck until Shutdown ends. 485 adjudications are not mentioned in a few articles that I read..Only that there could be processing delays.

The Department of Labor (DOL) will suspend all immigration-related functions during a shutdown, affecting PERM Labor Certifications and Labor Condition Applications. Filed and pending applications will not be processed, nor will filings be accepted during a shutdown.

U.S. Citizenship & Immigration Services (USCIS): USCIS should continue to process applications and petitions for immigration benefits during a government shutdown, though processing delays could occur.

Not much of an effect: USCIS is self-funded (fee-for-service) so it will be in full operation. DoL may be affected. FBI may be affected (background checks).

FBI will never be affected. Nat. security etc. DoL could be likely hosed though. That aint good news for any imm/non-imm steps that depends on them.

Topic: EB2 PD 2008 India - updates

Hi All,

My GC got approved today (01/19/2018). Got email and text saying "New card is being produced". Both mine and my wife got approved. Here are the case details.

PD :17-NOV-2008
RD :11-OCT-2016
EAD & AP : Approved: 06-FEB-2017
Received RFE for me & wife : 01-MAR-2017 for Medicals and 485 J Supp
RFE Received by USCIS : 22-MAY-2017
2nd RFE - 25-OCT-2017 : Signatures missing on 485 J Supp
RFE Received by USCIS : 08-JAN-2018
GC Approved : 19-JAN-2018

Friends .......Keep fingers crossed to hear good news soon.

Congratulations. We have the same PD but not even a hint of RFE for me ! Guess I may be stuck in the long haul of BC check - looking at others cases.

Congratulations, can you please confirm if you raised SR or any inquiry to get the RFE ?

Looks like my case also stuck in the background check like yours but didn't get any RFE on medicals or Supplement J till now. I recently raised SR but that was closed y'day saying standard reply.

Can you paste teh text of the response you got in the SR? I've added mine as well in another post

I have seen several people on this site getting greened and they were never asked for Supplement J.

I think if you change employer then for sure a Supplement J will be asked in RFE, unless you have filed concurrently.
Otherwise if you are with the same employer, then it is up to visa officer.

I think those were concurrant filers only. There's a guy in my workfplace whose PD was 2006 - he joined here filed concurrently a few months ago (AFTER the Jan 2017 notification that mandates Supp J) but he didnt get any RFE For it.

Topic: Dilemma - Should I or should I not change jobs?

I am also in the same boat with the same pd. I am a full time employee and we lost major projects. They are talking about layoffs. It is very difficult to continue on H1-B. If you have a good offer take it but the only thing is if there will be any relief, you will miss it. It will take another 5 years to become current

Dont want to rain on your parade but if current trends continue - 5 years will only cover probably Q4 2009 before retrogression Q4 2009 retrogression Q4 2009 hell that 2008 faced, at the min. you are looking at 15-20 years minimum for 2012. I'm really counting on the H1B pre-registration and an end to EB1C rampant filings for these crazy timelines to get relief but if it doesnt happen, a couple of decades is very likely wait time

I did raise an SR they replied saying they took a look and some "additional review is required.. and that they will process petitons in the order it was received".. didn't trigger any RFE or anything

Yeah. Even if I get current in Feb. I dont expect GC for another 3-4 months. Could be even worse.

does not being current before affect late triggering of RFEs? I filed my 485 in Nov 2016 when Date of Filing was accepted. In the other thread I see some guy with a PD 2 days later than mine getting an RFE without even an SR.

Dude,
what makes you think i have not added my case and stop being negative bro, Get moving !!

You added it AFTER I made this post (says right there on your profile - "added 18 hours ago")... and then you write a post taking umbrage and give me pep talk about Get Moving! I was just trying to help you get better answers and u indirect helping others...i had checked your profile to answer ur question and it didnt have the tracker. please dont try to make ridicule people who have been here longer.

anyways congrays on RFE. you guys are still better than my situation. i raised an SR and got a canned reply and no RFE with 17th Nov 2008 PD

Topic: How many days AFTER becoming current did you get RFE?

hopefully you wont get stuck in a similar situation. This wait under the current climate and the constant threat of retrogression is quite troubling. All I want is to get the RFE and move into the final "zone" of this long and ardous decade long journey...

Topic: How many days AFTER becoming current did you get RFE?

Hoping to get some Idea on how long it usually took to get an RFE. On another thread it felt like it could take upto 2 months but am trying to get a more better picture of how this has happened in the past?
