If they have got I140 EADs or I485 EADs, where would they be working instead? Why blaming H4 EAD folks now? They are equivalent to I485EADs or Citizens.




I am not blaming anyone. Just stating that they can find examples to prove their initial claim that H4 EADs are taking away their jobs. As i said earlier, court may find that number to be too low to consider. How many of 100K EADs would we working those type of jobs? 2K may be?

The issue is not only how many H4-EADs were issued but how many H4-EADs are actually employed and in what kind of jobs. It is not like everyone issued an H4-EAD is being offered a job. Many H4s are skilled professionals for whom the employment gap is a killer as far as new opportunities go

USCIS will have to come up with actual jobs lost by American workers to H4EAD holders to justify revoking of the H4EAD rule.
If challenged in court, the court will also have to be convinced.




They might try to come up with examples of H4 EADs applying for jobs and working at Walmart, Safeway, Best-buy, Frys, USPS and likes. Those are some of the biggest and most popular employers for majority of american population. However, i believe number to be very low.

So you think few thousands h1B abusing system has same impact as few millions DACAs abusing the system? You can't even compare the two. Those few thousands are not a burden on society and contributes tremendously while those few millions are simply a burden.

I don't know what you mean by intent to stay on temporary bases? Moment when one files for PERM and gets I-140 approved, intent to stay permanently is pretty clear and transparent in eyes of authorities. Nothing to hide.

Just a FACT: While 60% of population favors DACA for illegal immigrants that are already here, majority 79% of population believes in tight borders control and immigration priority based on a person’s ability to contribute to America as measured by their education and skills.

Every tom,dick and Harry is talking about lawsuit and other bullshit arguments. Get this into your heads, the root cause for all these issues is GC backlog. All other fixes are temp, so why don't these key board warriors think like an really high skilled labor and start working for clearing GC backlogs. How many of you here are calling your rep daily? Now don't give me a your BS reply that this will not work or other excuse.

Congress will pass the bill only if they see the numbers, not just letters or tweets. Real numbers, real people.




I tried to contact my local senate representative for california district-19 few weeks back. She goes by "Zoe Lofgren". I didn't get to speak with her. Besides, I was asked by her PA/receptionist if i was a dreamer and wanted to discuss DACA and i respectfully said "NO". I said i wanted to discuss issues that "legal" immigrants face like long GC queue and H4 EAD repeal. She said Zoe is busy right now and call later and leave your contact number, which i did. I sent her email describing issues and asked if i could meet her in person. I haven't heard back anything yet.

I went to her web-page later that day and first thing i read in bold/enlarged fonts was "STANDING UP FOR DREAMERS: PROTECTING DREAMERS WITH AN EARNED PATH TO CITIZENSHIP".

Really? How fucking freeloaders earned that path to citizenship? I was fuming, i still am. No wonder she wasn't interested in talking with me nor i have been contacted so far. California democrats' heads are so far up dreamer's arse that they smell like rotten salsa verde. Fuck this shit. I don't fucking care anymore. Call 100 representatives and no-one is gonna do shit for legals. Period.

I bet i will and i surely will. :). Democrits have ruined california anyways and every californian in going to hell in next few years. Billions of dollars of budget deficits, 70+ cities are in danger of filing bankruptcy, increasing crime rates, deteriorating and one of the worst rated public schools systems in country, one of the worst healthcare system, one of the worst roads in country and list goes on and one. Wouldn't be exaggeration if i said only a certain population is responsible for all of the carnage above.

California has budget deficit of few billions of dollars. Come one. One really have to try to hard to get a negative budget while you have silicon valley and people paying shitload of taxes until and unless you are spending a shitload in public welfare programs for freeloaders. I hear lots of SoCal schools conduct town hall meetings in spanish now days. Hospital ICUs are often very understaffed as they have to put extra resources in maternal care units to attend to needs of pregnant women from across the border for free. Lots of hospitals are shutting down as they cannot afford to treat freeloaders for free.

I am seriously considering moving from california to a sane state. Future is bleak.

DACA are not freeloaders. They were brought here against their will, know no other country and yet have no path to acceptance in this one. You want to be considered over them? You have a country, a good job, legal right to stay here, a place on the gc queue and options to return back to your country. Why begrudge these people the only help they may ever get. You want to even take away the little that they have to add to the loads that you have. That's not fair. And clearly that's not the American way. Americans clearly have more sympathy towards them, that's the reality of this society. If you don't like it then that's amazing because you have a choice not to be a part of this society. Also, unless one is a member of the voting public, technically one does not have an elected representative. It's called taxation without representation and all legal immigrants agree to this the moment they apply for a work or immigrant visa. The only elected reps we have are the ones in our respective countries of citizenship.



Lol. Average age of DACA recipient is 26 years. How the hell they can be brought in against their will? All of them? I bet majority crossed the border when they were 18 years or older. Many are taking advantage of the fact that there is no way to know their age when they came to the country.

What makes you think that it is not difficult for legal immigrants to go back to their native country? Illegals have a country to go back to and it's not as far geographically. Please don't preach me about american way. You are talking about same people who decimated native population, enslaved africans and nuked japs. Where was that perceived syncopathy of yours then? Is it fair that Illegals get representation without taxation while legals have to abide by taxation without representation?

Regarding last few post, i am not doubting that an H1B/H1B or H1B/H4 couple, both with 10+years of experience and exceptional skill-set and education, can make over ~$300k a year including RSUs, stocks and profit sharings from employer. I know a desi couples in bay area who make ~$370k+ working in medical and software field. They are anomalies among the people i know though and i have a big friend circle in bay area. Most couples with 7-8 years of experience make ~$240K+ a year and live comfortably. $300K in bay area would be equivalent to $700K in dallas and mostly top 0.1% earners amongst H1bs.

On Related topic, I am moving all of my balance in 401K from target date funds, which are more risky, to stable value funds. Looking more like we may see a market correction of ~15% or so in coming months. Increasing interest rates, Geopolitical issues, insane president, Russia probes, porn-star lawsuits and mid-term elections in november are recipes for disaster. It will be a buying opportunity of life-time once the dust settles and good to have cash in hand to invest then.

Topic: Do one need to file I-539 for h4 to h1B conversion?

My Wife is working on h4 for her employer and employer is filing her H1B petition this year. Immigration attorney is saying we don't need to file I-539 COS for new h1B and I-129 should cover COS.

However, i am getting conflicting information online. For example, I see on "Path2USA" that for H4 to h1B conversion one must file COS via I-539.

From your experience, is the immigration attorney correct?

Is it true when there is a recession and house prices go down, then there will be an increase in rent price because people need place to live? so even if there is an economic down turn, rent prices will always increase.

Of course, this is outside of immigration concerns. Solely based on economics.




I am not an economist but I think rents might just increase a tiny bit or remain unchanged during a recession. Let's assume current foreclosure and pre-foreclosure rate is 0.5% which means 1 in 200 homeowners have to foreclose on their property and rent out. This incoming flow is currently priced in rental market. Let's assume ~10% of homeowners have to foreclose now because of a recession and surely rental demands will go up because of this and prices will go up.

At the same time , we have regular renters who cannot afford to pay their rents anymore during recession. They tends to get more creative with living arrangements, such as moving in parents basement, friends home, renting out single room , moving back to india (just kidding:P). Thus more rentals are freed up and a balance is maintained between supply and demand in rental market. Hence, rents might remain unchanged.

Just my hypothesis. I wasn't here when last recession happened. But people here can confirm if they saw an increase in rents during 2008-2010.

Always a good decision to by home in hot property markets. I have h1B till April-2019 but decided to buy a townhouse last year anyways. not meant to be bragging but just to help you make a decision, Here is the current zillow description of my townhome:

This home last sold for $610,000 in May 2017. The Zestimate for this house is $750,960, which has increased by $20,123 in the last 30 days. The Rent Zestimate for this home is $3,185/mo, which has increased by $225/mo in the last 30 days.


I couldn't be happier as i have options to sell or rent [which would covers for my monthly mortgage premiums] if something goes wrong in my h1B extension in 2019. Only downside is, i had to sell most of my RSUs and Employer Stocks from stock purchase plan to make up for 20% down-payment , which is up by ~12% since last year. But my home is up by ~23% during same time period. :)

Good luck with your decision. I would say just buy a small 2-3 BHK townhome. Depending on your area, a 2-3 BHK might not be as expensive as mine and may still have good appreciation over next few years.

I have a strong hunch that fwd.us (Facebook's ngo) has a role to play in this plot. You can see the tweets coming from fwd and Todd schulte implicating that h4ead might not go away after all..

Fwd.us lobbies with US administration on behalf of silicon valley tech companies for immigrants because they need cheap labor to keep their businesses profitable



Yeah and i hope H4 EAD stays, but i don't want to take any chance. Also, I am from Silicon valley , work in Santa Clara and have friends who work in apple, google, Altera, intel , Qcom, Bcom etc. I find it hard to believe that they are a cheap labor force. They and I are paid at least as much, if not less, with compared to our teammates who have GC or citizenship. These companies have Salary matching Analysis tools which they run on yearly bases to determine no one is underpaid.

That is exactly what i think it is. I am not gonna be fooled by this ploy. lol. Good news is County affiliated org where my wife works on H4 EAD, has agreed to file her H1B. If we get it , we get it. If not, trouble is in the air. :(

Good news.....this should buy another few months for most H4 EAD holders to get an extension.

Just a thought: If your renewal is not until sometime next year, another option would be for the H1 holder to switch jobs and apply for H4 & H4EAD in premium along with the new H1 transfer, this way you don't have to wait until next year when you are due for renewal. My attorney said this can be done, however i did not need this as we renewed H1/H4 EAD recently.







I am in same situation. My h1B and my Wife's H4 expires in April-2019. So we could not renew before Oct-2018. However, changing job won't work in my opinion as you can just amend your current h1B which has expiry date set to April-2019. you do not get H1b extension just for changing the job. Let's say if i change my job this month, my H1B just needs to be amended and i can not apply for extension before 6 months of expiry date.

Since my h1b is still set to expire by April-2019 while i do amendment , H4 EAD is also tied to that expiry date. You can not get h4 EAD extended beyond expiry date of h1b.

You my friend have made biggest mistake of your life changing job and leaving your PERM hanging in thin air. One they pass the rule, everyone after 2008 PD will get GC in 2 months. :P
