Just call USCIS customer service and request a status update. They will be able to find out what is going on with your application and assign you a case/inquiry number to follow-up on.

Topic: Can I buy Home in H1B now

Just ignore naysayers and buy home as soon as you can. People have been predicting for stock/housing market crash for 5-6 years. Instead it keeps going up. Look at S&P500, DOW etc. Don't get left behind. JMHO. I bought home last year and happy about my decision. My mortgage is less than what i would pay to rent a similar 2-3 BHK in my area. Just in case if i have to go back to India for unforeseen reasons, i would still be able to own the property and pay my monthly mortgage off rent i will receive. Good Luck.

I hope you are right but remember they used the word "certain" in 2015 h4-EAD rule as well. So context of the this word remain same in 2018 rule. Certain = Spouses of H1Bs with an approved i-140.

Issue is she works in high cost geography. Specifically, San francisco. I am sure 58K a year won't go a long way in SF. I will find out SOC Code/Wage Level today.

As i said, my wife has been working with same employer on h4 EAD for last couple of years and want to continue to work when/if H4 EAD work authorization is revoked. I am just trying to think feasible alternatives and h1B is one of them. As per initial conversation with her employer, they said they are afraid as they haven't filed any H1Bs being a government affiliated and funded non profit org. Again, her employer is not desi consultancy as some of people here are judging.

What i want to know is:

1- If they don't agree to file for H1B, is it end of road for her employment with them once h4 EAD is revoked?

2- Let's assume somehow we convince her current employer to file for H1B. What are chances of RFE and denial with her being on low salary.

I am sorry, i have no experience with any of consultancies and what they do. I was hired by my employer directly and thy have Fragomen as immigration lawyers. Please bare with my naivety but how that would be fraudulent if i decide to pay my own money to that employer to file for h1B?

Long story short, my wife has H4 ead work authorization until Apr-2019. She earns ~$58K a year working at non profit government affiliated healthcare organization.

I am thinking applying for her H1B before April as her employer, being a non profit org., is not ready to pay for this. I know this is high risk high reward move. If granted H1B , she will get work authorization for 3 years. If not i will lose few ks as chances of RFE and denial are high imo.

Have anyone done this successfully? Do i have a slim chance of getting her h1B this year? Would appreciate any advice/opinions.

Not entirely true that you have to have a selling agent and pay him 5-6%. In fast moving markets, you can do "for sale by the owner" if you do your homework right. It will surely save you 5-6%. Also, if you sign-up with sites like redfin or zillow, they will also guide you through selling procedure and they will take may be 3-4% in commissions.

Yeah bought $650K condo last year in bay area. So far happy about my decision as price went up to $740K in short period of time. Worried as bay area housing may have a mini crash if handful of H1bs have to pack their bags and go. Demand will plunge and so do property values. keeping my fingers crossed and paying close attention to h1B reform. Might as well sell my condo for a profit and go back to renting if bad news is confirmed by mid year.

It's a misconception that every employer in Silicon valley pays $200K. I work for one of fortune 50 companies in Silicon valley. 2 promotions so far in 6 years. My base is $103K and with comps and other benefits i make ~$135K a year. Companies like apple, nvidia and microsoft sure do pay more for 5-6 years of experience but it doesn't exceed $150-$155K for sure. I have friends working in those companies. Not sure about FB or twitter though but they represent only a small fraction of employee population in Silicon valley.
