Topic: JAN-2018 Visa Bulletin

no impact since all of it will be consumed by EB1 as spillovers...nothing will get spilled over to EB2

Topic: Upcoming Dec Bulletin

If AOS was filed on or after Sept 01, 2007, then the application included the USCIS filing fees. As a result, USCIS filing fees are not required for EAD and AP extensions, although legal fees do apply (if attorney prepares 765 and 131 forms).

Additional information
https://www.uscis.gov/i-131
You do not need to pay an additional fee for Form I-131 if:

You are filing Form I-131 Application Type B or D;
You filed a Form I-485 with a fee on/after July 30, 2007; and
Your Form I-485 is still pending.

EAD/AP Fees for Pre-Jul/Aug 2007 Renewals - https://www.murthy.com/2013/03/05/ead-and-ap-ren...
Many MurthyDotCom readers are eligible to file the EAD and AP initial and renewal forms without separate filing fees. This is a bit confusing, as it depends upon the filing fee that was paid with the I-485 filing. All applicants who filed the I-485 after August 17, 2007 paid a one-time filing fee and do not have to pay additional USCIS fees for EAD and AP filings.

If the employer terminates your contract you are free. But if you leave next week looks like you have no intention to work for that company after gc, so lawyers recommend 6 months; however, I don't know any case that had problems during citizenship process. Do you have a lawyer? ask him. Do you know friends that leave the company before 6 months period and are now Americans?

Sure. I have a lawyer. But I don't want to ask that question now :-). Anyways thanks for clarifying

Now you need to wait 6 months before changing jobs.

Just curious. Do we really need to wait for 6 months before changing job ? IS there any legal clause like that ? what if the employer terminates you after 3 months ?

Topic: Employer threatening to revoke my H1B and I140. Pls help!!

Just to safe, submit your resignation after the H!B with your new employer is approved. I have seen instances where H1B transfer was denied if it gets into the RFE loop typically in vendor client model.

Otherwise you are good like others mentioned. The employer cannot revoke your I140 since it is approved and older that 180 days.

Good Luck.

ur good to go

employer cant do anything

just find another employer..transfer ur h1 to them once u eceive the receipt form usics resign from ur curent employer

even though he cancels ur 140 ur fine as u already passed 180 days..if u get RFE from usics just send ur future emploer offer letter with 1 or 2 paystubs

Topic: April 2017 i-485 Pending inventory released

Quick question, hope someone can clarify this?

In the pending inventory for India table, I see 1770 for the year 2010. Does this mean 1770 people have filed I485 for adjustment of status and their applications are pending because of visa number unavailability? If that is the case, then when did USCIS allow people with PD in 2010 to file I485 for AOS?

Topic: June VB Out

excerpt from VB

D. OVERSUBSCRIPTION OF THE CHINA AND INDIA
EMPLOYMENT-BASED FIRST (E1) PREFERENCE CATEGORIES

Readers were advised in item D of the May Visa Bulletin number 5, that it would be necessary to impose a date for these two countries in the near future. The continued high level of demand for E1 numbers for USCIS adjustment of status applicants has required the establishment of a date for June. This has been done in an attempt to hold number use within the Worldwide E1 annual limit. The E1 date for these two countries will once again become CURRENT for October, the first month of fiscal year 2018.

Just to add....the VB is giving the current snapshot. Even if the date has not been retrogressed unless the visa is available your 485 will not be processed.
