Thanks for the suggestions guys. Iam little relaxed, now that I knew you can always file I-140 in EB3 if EB2 is denied.
I was under the impression if I140 is denied you have to go back to PERM again.

I have a bachelors and Masters from US. Before joining the current employer I had little over 5 years exp including exp I had while doing my Bachelors. USCIS did not consider this a exp, Iam working with my current employer from past two years.

Below are the exact wordings from I140 RFE...

The form ETA-9089 you submitted indicates in Section H, boxes 10 and 14 that 60 months of post-baccalaureate progressive experience is required. In section J, question 21 you marked that the beneficiary was not relying on experience gained with you. In General, if the answer to this No, then the experience with petitioning employer may be used to qualify for the proffered position only if the position was not substantially comparable to proffered position. If the beneficiary is relying on experience with you, submit a evidence that his experience with you is not substantially comparable to proffered position.


By submitting evidence that my role is changed and duties will be atleast 60% different and experience gained in H1B role will add to requirements for PERM position, what chances do u think I have towards approval?

I dont have any recapture time left, Already filed for unused H1 valid till end of dec-13. My perm was approved on Sep-13, i think it is valid for 180 days from so till around March-14

I fell short of 240 odd days. I joined current employer 2 years back, after more than one year they filed labor. Cant we use one year exp from current employer?

My Perm Ad said 5 years of exp but looks like they dont consider the exp while doing bachelors.
Our attorney is responding back RFE to consider the exp from current employer pointing out more than 50% change in duties and role change.

What are my chances of approval, also can if it gets denied can we refile I140 in EB3 using same labor? My labor was approved in Sep-13

Do I have to sign the physical PERM approval letter from DOL to file I-140 in EB2.

My lawyer did not ask for it, does it mean it is not been filed yet? Is there a online submission of I-140 like PERM where there is no signature is required?
