Hi, I need some help here. I filed H4 EAD for my wife but I paid excess amount $495 instead of $410 thinking that I have to pay even for biometric. Will my application be rejected or can I get a refund?

1. How long will it take to receive a receipt notice. - You should get it in 1-2 months

2. What will be the usual processing time in regular processing. - for me it took exactly 8 months. should be faster now

3. Can I work with a approved LCA while waiting for the amendment receipt num. - You can work as long as your I94 is valid and post I-94 validity 240 working days..

Hello Mr. Doomed: Let me rephrase my sentence - You need to stop working immediately and your lawful nonimmigrant status ends, and you are out of status. Your DL will expire and as your attorney said you will be on LOP. If someone is there to take care of your day to day expenses and house rent its good if not no one wants to be in such situation and prefer to go back and wait for the approval in India.

If your application for an extension of stay is approved, the approval will relate back to the date your Form I-94 expired, and your status while your application is pending will then be considered to have been lawful.

If your application is denied, you may be required to cease employment and depart the United States immediately. In addition, any nonimmigrant visa in your passport granted in connection with your classification becomes void. Once your visa is void, you must submit any new visa application at a U.S. consulate in India.

In short, you have to stop working and it's advisable to leave the country and come back once your VISA is approved. Hope this helps.

H1B Amendment Approval (I-129) at VSC

Case Received : 15th September 2015
Case Approved : 26th May 2016

It was Normal. Didn't convert to Premium. So guys have patience and just wait.

For those who have H1B Extension with I797 and I94 but Amendment is still pending can travel to get their VISA stamping on the basis of their I94 and the receipt notice of their Amendment. Dependents can any how go for VISA stamping as the amendment is only for Primary Applicants.

For those whose I 94 expired and still waiting for Amendment approval or H1B extension petition approval and have completed 240 days need to stop working and go to India and wait for the approval.
