Topic: EB 2 India Priority Date - Decade Wait?


Hello all,

This is my first post and I understand that this might have been discussed here multiple time. I am not venting out but I was going through this website - https://www.myprioritydate.com/ and looked at the estimated date an application will become current for Dec 2017 (India) priority date. For priority date in Dec 2017, the website indicates that it will become current (under EB 2 India) category in 2030. This is 13 years of wait.

I am going through the following emotions:

1) I have spent around 4.5 years in US in IT sector and worked very hard to get to where I am right now. I pay my taxes on time, pay medical bills on time, haven't defaulted on any loan and credit card payment.
2) I am in process of planning for family which I couldn't do earlier due to so many uncertainties in life.
3) Every time I need to renew house lease, I spend countless hours to check if extending another year is right decision or not.
4) Every time I do a VISA extension, plan for trip to India, pass through custom, I have this feeling inside me - "is everything going to be alright" (even though I am from a very reputed company who is very ethical in terms of VISA/PERM filing).
5) I have no plans to buy house until I get GC.

My point is this - I am struggling on a daily basis, working hard to put together a family who can have a decent life, enjoy a meal at a restaurant once a month, providing for my family in India with less than $20,000 in my own retirement account. And, then, I understand that I need wait for 13 years to get GC in EB2 with a likely need for extending H1B for 3-4 times (no hard feelings for the website, they have done a great job with helping folks get a reality check).

This is not America's problem. It is a problem with so many people wanting to migrate to US. I am no exception but sometimes life just seems so hard and challenging. I wish it were a little less tough. I am sorry, I said I won't vent out which I probably did. I am just thinking about others (especially in EB3) who have waited for almost 10-15 years and are still in queue. I guess this is the price we need to pay for being hard working and honest people. In the end, I hope its worth it.




haha.. too much optimistic. wait for 2-3 years and keep visiting forum, you will realise how much time it takes. Any one after 2012 priority date, will not see GC before they retire which I mean, at least 25-30 years with the current numbers unless there is change of law.

I dont know what the future(WTF) goes on here in these forums. We are already working here, so we are already here with jobs. Whats wrong if every one gets Greened and that too fast. I dont know why the future(WTF), you guys fight for nonsense. The attitude, only me, me, me never ends with any thing..At least GC for every one here need not be just only one..

At last some sensible posts other than posting, I am great and all others are nonsense. my kid is born in US. I came in 2007 and used up all vacation days and gathered to get a priority date of 2013. I feel, I might get GC in 25-30 years from now, any thing before is a medical miracle or miracle like they say in desi movies. That would be my retirement age. Being optimistic doesnt work, it means you are only sleeping n dreaming. I follow the GC/perm numbers filings/approved very closely. I work full time with one of the big us company. We have a good amount of vacation days. So I go to India every year. my friend who applied when I came here, he is a citizen now.

As I know, Its 21 years, not 18yrs when Kid can sponsor for parents as some one said in other post.

I am not an IV member neither i am asking anyone to become one. You can correct me if i am wrong but currently we do not have any strategy nor direction and IV seems to be the only group that at least has some strategy i am not asking you to trust them or that their intentions are good however it does not hurt to follow a few things that they have suggested for example reaching out to your congressmen or liking a tweet from Kevin Yoder. These are things that you already suggested in your post.

I have not donated to IV, but i did write a letter to my congressmen as it did not take any time and i did like the tweet from Kevin Yoder when he posted about HR 392.

I will be happy to follow any other strategy if there is one and does not involve me donating money.





Exactly in same thinking.. Many people in this forum posts for and against IV sitting in office. IV do publicize a strategy but no one knows, whether they are working on it or only doing publicity.

Not sure, tweeting and posting on social forums helps in anyway. It needs to be done on ground. We dont have a valid forum which does that.

And many people will be like sit and do nothing but try to bring others down and write comments as I am doing now

Forget about congressman. I believe, Indian people who got their Citizenship do not like to see H1 people coming and does not want another Indian to come over. Bhai Bhai ka Dhusman :) Lobby to stop us is from our own people too.



Agree with you. My close friends who came 2 years ahead of me, now, got their citizenship too(They applied for GC immediately, I waited till the last moment). Now they are saying,

"better they stop all H1's. With immigration, kids will also have more competition".

Its all too many rumors of not being good at POE. I have been to india in Feb and came back, it was cool. More rumors on news and less at airport. 3 of my friend have come in last 2 months, no issues seen.

That is why you have to submit "Birth Certificate" while applying 485 along with other papers, this is a very important piece of paper. Lots of application get RFE regd. same. Passport is not considered as alternative of "Birth Certificate" ...

As every one answered, you would have got the answer. I am here from 2007. My PD 2013. This year, when i went to vacation and came back to US, the Port Entry stamp date/month was same except the year which is 10 yrs later. I goto India every year for a month. That helped me to capture few days while filing for GC. If I had filed for GC when I came in, I might have got Citizenship by now, as my friends did.10 yrs back the situation was not this way. May be 3-4 yrs wait time, we would get GC, so thinking at that time was completely different. Now, here I am, and GC is not even imaginable with in 20 yrs from now which would be around retirement age in the country I came from.

And one wont understand/feel the situation, untill they face it personally.

I went thru the same scenario. If you are in Same MSA, You need to file LCA before you move or else you might need to file H1B amendment after you move and no LCA filed.

Hi all,
First of all, I thank everyone on this forum for helping to answer questions. I have a question regarding my Green Card process which is in very early stages of the but would like to know how my GC process will affect if my employer moves.

Currently I am in a location whose lease would expire in next 2 years and working for an employer(no client, direct employer). By then I am expecting my I-140 would be approved and my wife who is on H4 would be working on EAD. Currently I am on 4th year of my H1B. I wanted to know what would happen if my employer moves to another location in same MSA (within 10-20miles).

Will my employer have to start the GC process all over again? Will my wife who would be working on EAD have to stop working if the process resets? As I mentioned, I am in the early stages so I don't have much knowledge about the whole GC process. I tried searching for this specific question on internet but was unable to get proper answers.

I don't know why many people are posting about revoking or adding new rules as if they know insider info. What non sense. Everyone is thinking to be positive atleast till their priority date. If govt want to throw all GC and h1's, they can throw everyone out or they can give every one a GC. Anything can happen depending on congress or President. Keep it tight why nonsense discussion and throwing mud on others. Let's be positive and move united and stay united. It will help us.

folks -- I think we all understand that India born individuals have to wait much longer and we all empathize with them also. However, at the same time, IMO, it would be unfair to take visas from other countries and hand over to citizens of 1 or 2 countries. Secondly, a key thing we are forgetting is the spillover. Its not always that ROW gets to use all of its immigrant visas for a given fiscal year. The rest anyway get allocated to India so effectively India-born individuals get much more than 7% (I doubt btw that any other single ROW country even gets to the 7% per-year marker!)

Thirdly, folks in EB2/3 are really high-skilled I am sure. I think what's hurting them is the whole rush of EB1-India visa usage by the 'managers'. This is not allowing any spillover to EB2I/EB3I. I think this is where India-chargeability folks really need to raise a voice with USCIS or their congressman/woman to move EB1C mgrs to EB2 and to really go after the wipros/HCLs/TCSs etc.




I dont think, the spill over from rest of the world is being used. thats the whole argument. Only spill over from EB categories from a country will be assigned to other EB categories of the same country.

I agree that skilled visa should be based on skill set. That's exactly why there is no quota or cap on the h1b. The green card is NOT a skilled visa, it is a permanent residence visa. You seem to be mixing the two. A country is perfectly allowed to regulate who gets to live permanently within its borders and that has nothing to do with skill.




Too much of nonsense. We all know what every body does. Many people who doesnt get jobs in their country, come on student visa and does masters and get trained with some consultancies and with some fake exp, get a job. With exp get a full time and create a non sense here. If some one has experience come to US obviously with some consultancy and get a job full time. Before writing some nonsense speak to your heart dudes incase you have one. Everyone knows what they did. Dont forget your roots and what you did. Dont write too much of nonsense and make others miss the important updates or valid questions posted in the forum by some people.

And also we know, why US gives the Citizenship. Its all about to get people like Elon, and others. And the people like them will not have time to watch this nonsense. So at the end, its the common people, we know how we came here and why we came here. So please keep shut.

I dont know why guys in these forums fight. I see this issue from our Indian ethnic group. I feel, very much similar to caste problem - mine is best and all others are rubbish. And most of the negative statements are from who have already got EAD or GC. And from people who are jealousy. Common guys, fighting on this forums doesnt help. Provide some good information or help in good movement.

Are you working in IT consulting companies, I know they suck.

People on H1B are making $200-$250k !!!!, so don't think they are saving just $1000 a month. It might be between 3-4k. I don't know, it depends on person to person though.



wow $200 to $250k!!!. please tell me which company pays those salaries, i will forget about my GC process to join them.
there may be 2 or 3 companies and that too might be 2 or 3 positions in those companies paying those. Are you making that much? if so tell me which which company is paying those salaries.



I have few of my friends make 200K on h1 with FTE along with bonus and also on Consulting.

I have never faced this kind of situation at work. I am treated the same way my fellow co-workers are treated in Finance.Never had any issues with my career and growth.But in my trading domain, all that matters is knowledge,expertise and skills and there are less H1B's. I am also tired of this visa extensions ,stamping and this backlog. I wish our wait for GC comes to an end sooner.

I don't know anything about the IT consulting and IT Projects .Only thing i heard from FTE IT Indian guys in my company that those international managers from consulting companies making less than 90K per year gets their GC in a years time. Lets not complain and focus on what we really want to achieve in life.





I too never faced any difference between me and localites. Its the feeling, we might easier target and if localites loose job, it doesnt matter much for them but for us, we are immediately out of status. Its that fear keeps us on toes always.

You have no idea of how consulting works and zero idea of what the actual rules are. If you don't know the basic foundation of how a consulting firm functions I cannot help you. Yes any consulting company including the big 4 can hire a MANAGER and send him as a DEVELOPER. That is how companies operate whether you like it or not and it is well within the rules of USCIS and doesnt account as fraud in any way. USCIS are not fools to approve eb1 visas. They are surely smarter than you orelse every single person applying for visa would be rejected.

--- This is not with in the rules, its jsut USCIS doesnot have a workforce to come over to each location and see what they performing, the consulting companies are breaking the rules. And It is because of this, some times, Infy and Wipro had to pay huge fines. This rule was not yet focussed fully by USCIS. Once they focus on this, then for sure, companies will start doing naagin dance again.

That's a loophole in US immigration. When US Immigration policy was developed in early 1990's there were no IT body shoppers and EB1C was primarily meant for those managers from Manufacturing sectors. Immigration policy never changed and IT companies took advantage of the same. I have a business degree from Columbia University and i am an investment banker.I earn much more than what those consulting companies international manager earns here. But i don't qualify for EB1C as i don't have 12 months of international experience within the same company. Sometimes you get annoyed with the policy because you are ignored even after spending close to 200K in this country on your education. This is how life is.

Raise your concerns, but don't fight and make derogatory remarks. It's not going to help and get you anything in life. I know having a GC is very advantageous. But honestly if you have knowledge, expertise and skills, no one can snatch anything from you.



Knowledge, Expertise and skills -- These things are Good only to see and write... But but, the fight is to grow higher up in the ladder, if we take choice, again we have to start from scratch and from that point, it might be 20+ yrs. Being FTE on H1, we need to be on toes all the times, with all localites in project with one h1. Like if we have the time frame of 15yrs to get GC, continuous 15 yrs on toes for higher as H1 might be a easier targer if group doesnot perform well in span of those many years..
