Your wage level is determined by your employer which they have got it from DOL website. END OF THE TOPIC.
If your wage level is I then ask your employer to file new H1 with level II. Because level I is for entry level jobs as per the USCIS and that job is not eligible for H1. H1 is for exp professionals, and you should be paid more than what an average american is getting paid.

Dude, your LCA should have an option to select the wage level. Its a check box. First, go through your LCA it also has your salary on it.

Your LCA should have SOC code, get that SOC code and check against the DOL's database for the wage level. Ex : if your SOC is 15-111 then enter that into the DOL Wage determine website. Actually your LCA should mention from which website the wage level is determined.

what are you talking dude? Just chill, you're in frustration. They are rescinding the rule with a rule making process, which is legal. You cannot file any case for your risky investments. Paying taxes is also like investments but in return you get some services instead of cash. Coming to attorney, Fuck them. They are the real reason for not getting I140 EAD and now you want to discuss with them about H4 EAD. what they gonna do? Raise money for lawsuit? Why don't you participate actively for permanent fix instead of wasting energy with these ideas. Please come forward and fight for HR 392.
