My lawyer said this had been the first time his saw a RFE on this issue.

It didn't explicitly ask for a new PL, but it listed the three new elements and said "if these three new elements are satisfied, USCIS may approve the national interest waiver as a matter of discretion". I think you would want to explain how the requirements are met, and that almost means a new PL.

I have received the 2nd RFE. It's very interesting. Here are a few things I have noticed:

*The adjudicating officer has changed.
*This one is signed by the director of TSC. The 1st one doesn't include a signature.

The letter says USCIS notes it previously issued a RFE; however, it did not address the three (new) elements required. They ask me to provide letters from my employers to show that I have at least five years progressive post-baccalaureate experience in the specialty.

It seems like a straightforward request. But I think the old standard also required this, wasn't it? I don't understand how this is triggered by the new standard.

I think my case is not a typical one, as I'm not a scientist. I'm a science writer. I provided eight recommendation letters, a sampling of my 300 published articles, book chapters including foreword to a autobiography of a Nobel laureate, a documentary series viewed by over 10 million people, 14 media reports on my work, etc..

The 1st RFE was a cut-and-paste one. It didn't mention a single sentence of my petition. I haven't received the actual letter of the 2nd one. I'll share as soon as I have it.

Hello guys,

I just received an update for my NIW petition. They gave me a second RFE!

TSC
The case was received on 8/16/2016
First RFE sent on 10/14/2016
My response was received on 11/30/2016
Second RFE sent on 3/13/2017

Since my EB1a petition was approved earlier in February, I can simply withdraw this NIW one. But, still, this is funny! Seems like the change of ruling does generate more RFEs. I wish you guys good luck.
