That is correct.

Sounds like you have applied for your H1 renewal which is pending? If yes, try to process in Premium mode if possible so you will get approval/denial within 2 weeks.

Again, plan to leave the U.S. after you have your H1 approval so you can stamp your H1 extension in India. That way you will keep your visa status current by traveling in/out in your visa. Your EAD or AP although awarded and exists may not be used until required after your visa expiry or max-out. Good luck!

If you have a visa, enter through a visa. It is always a safety net. AP is your back up in case of urgent travels and if you need to enter when you dont have a visa.

As long as you have the ability to live in the U.S. with a valid visa, H1 or L1 keep renewing or extending. During pending AOS time, it is better to stay in visa than in EAD/AP always.

Topic: May2015 EB1C I-140/I-485 Concurrent

My case was filed in EB1-C during Feb 2015 and I have both my I-140 and I-485 pending for almost an year. I received EAD/AP on time for 1 year and I have filed for renewal since EAD/AP is expiring during April.

I recently raised a SR for my i-485 and they responded back that there is no action pending at my side but the cases are under extended review. I wouldn't be able to check on my pending i-140 application since I should call with my employer and they wouldn't do that because it is a very big company.

Can someone please specify what they did sequentially to lead up to the Info Pass appointment? I suppose my SR requests recently raised were closed because they responded through email that no action is required. Please suggest.

Yes, I am hearing many waiting for more than a year for I-140.

There are cases with 3 months of time concurrent filing I-485, I-140 and sailing through. It is just the way it is... strange. As long as it gets approved, I will take it...
