My received date was 6th june 2017 at VSC. Today i.e. 24 th April 2018, my case is updated with RFE (after waiting almost 11 months).And I have valid I94 till August 2018. I have not received the details of RFE yet. It will be a great help if you send me the RFE details.

And can anyone tell me after sending the required evidence to them approximately how much time is it going to take for the approval?

Is it better to wait or go to india for stamping am graduating in july 2018?

I have been following this thread for a while now. I just got notice from USCIS Today.

Received date: June 8, 2017
I-94 expired: December 21, 2017
I-539 application DENIED today April 24, 2018

Unfortunately, I aged out of my E-2 dependent visa when I turned 21. Not sure what to do at this point since technically, now, I have been out of status for almost 180 days.

I have yet to receive the explanation in the mail. I only got my notice via email. I’m assuming that it’s both. My I-94 expired when I turned 21.

You have been out of status but not unlawful presence. Your unlawful presence begin from the date of denial which should not go over 180 days to become eligible for a 3 year ban.

Unlawful presence is different from unlawful status.

In case you find yourself eligible with unlawful presence, you may file I-601 to waive the unlawful presence.

to my knowledge, it all depends on what RFE they have requested for. Worst case - it can take 45 to 60 days but unlikely.

If you are kind of OK to visit India and you have a fall back visa like H4, I would go for it.
