@sunnyspandu:

1) H1B Amendments are taking a long time (this is what I heard from everyone I know). Mine was filed in Nov 2015 and I haven't received any updates yet.
2) How long do you have your visa valid? They have to have a copy of your visa when they leave for stamping. I am not sure if receipt is enough or not.

Thanks.

Can anyone answer this, if H1B amendment is filed, and it's taking 10 months, what happens if someone in that 10 months, let's say after 6 months, changes location again. Can they amend the amendment, just curious of a situation like this.

Hi,

I have been working for X client for almost 3+ years in AAA location. On April, i have moved to new BBB location for same X client for different Project. Before moving to new location , i have submitted all my documents to my employer for H1B Amendment. My Current visa valid till June-2017. But due to some internal issues(uploading docs in employer server) my employer filed my amendment case on 31-May only.Almost after 60 days of movement they filed my case. What will be the consequences of late filing?(only evidence which shows BBB address is my last month pay stub).
How to overcome this problem if i get RFE ?

Please advise.

I'm thinking to go with premium. I got to go for visa stamping and this wait time is killing me. Oct 27 2015. Heard that few october petitions got approved a month ago. But, no movement since then.

What is the current H1B Amendment approval date at Vermont service center. I applied on Dec 31st 2015 and still waiting.
Any one got approved this week and when did you file your Amendment?

their processing date for h1b extension (apparently heb ammendment falls under this head according to my lawyer), had jumped to January 2 2016, before coming bact to October 2 2015

to hippagun:

1. Yes. Acknowledgement is enough for Visa stamping
2. You can fill up DS160 and block the stamping date. Waiting period is 2-3 months to get stamping slot.

Hi, I have got my stamping done yesterday and its approved. Still stamped passport is awaited.

I have got stamping done for client A however it seems there is no opportunity for client A now .

If i need to travel for client B what is the procedure? When can amendment be filed and does amendment acknowledgement is enough to travel? or i need to wait for approved petition document? I am planning to get the amendment done under premium process.

Hi - I have two pending cases with USCIS.

1. Amendment - Filed October 2015
2. Extension - Filed July 2016

Can i process my Extension in premium while my amendment is still progress ?

to gautamk:

you can. But
1. If H amendment (filed and pending at USCIS) is denied, and H-1B extension is approved, USCIS could issue notice of intent to revoke asserting government error and then revoke the H-1B extension approval because under immigration law if the underlying H amendment is denied, the extension should likewise be denied.

2. USCIS could hold the H extension decision until the H amendment decision is issued and then resume the 15 day processing time requirement (i.e., you will lose the advantage of quick case processing and the premium processing fee because USCIS needs to wait for the H amendment to be adjudicated as a matter of immigration law).

Hi

The Processing time as per the below Link says that the I-129 is as of December 2015. In that case you have way passed by October. Did you check with your attorney on why isn't it picked up yet.

There are lot of people waiting for almost 1 year (I personally know many of them). I think they have stopped processing. if you want approval/rejection soon then you must upgrade to prem else just wait.

True. The last I heard was (two months ago) they approved one petition that was filed on Oct 2nd 2015. Mine was filed on Oct 27th. I have already waited too long for it and yes, it looks like they stopped processing any petitions that were filed under regular processing. I made mine premium processing on 19th sept. Waiting for the decision. It is pure waste of time going with regular processing with USCIS. Looks like they want to grab more money from immigrants.

For anyone waiting for along time for amendment, you can get in touch with your congressman if it impacts your job and it really helps
I did the same and got the needed relief for my extensions
Lets stop giving money for premium processing to USCIS whenever its not needed
