Hi, If client change is with same employer, then they can withdraw your petition and apply for a new one.But if it is different employer, then it cant be done.

Hi, I moved to new employer in Dec 2015 and applied for visa transfer and extension on 29, Dec 2015. My petition is still pending with VSC. My first employer's visa got expired on May 2016. I'm planning to go India next month but My new employer is not willing to apply premium and asking me to wait. How long should I wait more? Do I have any other options?

Can you please tell why does n't your new employer agrees with your premium processing. It means you joined after getting receipt number. This time processing is very slow. Please check with your new employer and apply for premium processing.

I filed the H1B extevsion from my current employer before my i-94 expires and after that i got another job and filed H1b transfer from new employer after my i-94 expires with current employer receipt notice .Got RFE fo rmy current employer and about client letter and got RFE frormy new employer as well about RFE from current employer .USCIS is telling that they can not approve my case untill my current employer responds

What i can do in this situation ..i already started my job with new employer

Please need help

Hi dvsa, thanks for your response.

My new employer filed my petition under in house project, without client letter. Now if i want to apply premium, he need to file amendment with the client project. His Attorneys are not recommending to go for premium now as there is a chance of getting rejected and will impact his future cases(?). So he is refusing to turn premium. I'm kinda stuck with my travel plan and do not want to wait another 3 months :(

gurus

please advice if i can travel on h4 valid until 2019 and my husbands h1b amendment is with uscis in "case received state" since 1 month.

his earlier h1b was extended until july 2019 and then filed his amendment in aug due to a client change

Yes you can very well travel while his amendment is still pending. I just did that last month and had no issues when I returned back.

I am sorry I didn't get your initial question right. In my case, it is our first H1B and the extension is not filed yet.
As my I94 valid till 2017, I didn't had to go for stamping.

True. The last I heard was (two months ago) they approved one petition that was filed on Oct 2nd 2015. Mine was filed on Oct 27th. I have already waited too long for it and yes, it looks like they stopped processing any petitions that were filed under regular processing. I made mine premium processing on 19th sept. Waiting for the decision. It is pure waste of time going with regular processing with USCIS. Looks like they want to grab more money from immigrants.

Hi I have quite a strange situation, I was working based out of Colorado (Petition valid till june 2017) and filed an amendment for a different client from illinois and just before travel to iilinois the project got cancelled and i traveled back to India and now the client came back saying that the same position opened up and asking if i can come there.

What can i do now, my amendment was filed as non premium and don't know how long it may take, can I now travel back to my previous Location (Colorado) and then travel to illinois from there? or do i have to wait fro my amendment to complete.

As you have a valid visa, you can travel.But your I94 details will change.Sometimes, this may be considered if they check your I94 date of entry and may ask for further documents.Sometimes, it will not affect.But as far I know, you can travel.

My wife had an H1b till Sep 30 2016 for Texas, in June 2016 she filed and amendment for SFO and traveled with the amendment receipt, in September her extension has been applied. In January 2017, a position is opening up in my project in NJ, can she again file an amendment again while her 1st amendment and extension is pending?
Also what if:
1. SHe gets an RFE on 1st amendment- does she have to reply to it?
2. She gets an RFE for extension, what details should she reply back with, project in SFO, or project if she gets in NJ?

Did any one filed in regular - VSC after OCT 2, 2015 got updates? Its been 3 months USCIS updated processing dates in site.
Is anyone knows what's going on with VSC centre? Are they processing regular or not? Its been a year we are waiting! worrying will this lead to out of status since my base visa petition expired on May31, and soon will exceed 240 days of expiry:( My employer not filing premium because of some internal project allocations.

also, can we not convert amendment to a amendment+extension and file in premium?
or amendment in premium and extension in premium both have to go in parallel?

I have to travel to India after 2-3 months.... so should i continue to wait for amendment approval and not apply extension?

My application was dated Dec 2015 @VSC. I don't have any update.. USCIS updated there processing times and looks like they are still processing OCT 2015. So your's should be processed soon.

Hello Everyone,

I filed my amendment on October 13th 2015, after 6 months I moved to another client with in same location without filing another amendment. After completion of 1 year also it was showing "Case was received" on USCIS. I am looking for premium process, but I have few questions

1) Can I work on client location even after completion of 240 days processing time.

2) What will happen if I go premium processing ? like They will deny my amendment or RFE?

Note: I have valid H1B Visa until September 2017
