Immigration Came to my Client Work Place

Hello Friends,

Need help please. I was working in client place where my I 140 H1b extension was filed and my petition was approved in November 2017 for 3 years. Today while working immigration officer came to my office and asked few question to me and my senior director about my client , pay and role and responsibilities they taken picture of my cube and asked my senior director to send the invoices. I have question whether USCIS will create any problem as this is there 2 visit with same client.

this happened to a friend of mine too, USCIS officer visited his office. he was in a meeting at the time he was called out of the meeting, asked a few questions on his role, pay, reporting, experience, qualifications, etc. He was asked to email a bunch of documents to USCIS post the visit... this was around 6-8 months back, everything fine since then..

This is nothing new, and nothing to get worried about. In my 10 years on H-1B, I got visits by USCIS on site twice. Answer truthfully to whatever they ask and provide all the required docs, you'll be fine. Only concern is if there's any fraud going on, which is what they're trying to identify.

What happens if someone is not in office when they make a visit? People could be out for anything for a while.. like for a personal work or something.

Nothing to worry! My advice is honest with them. Don't tell them to lie about your role, responsibilities, and resume. USCIS going hard on-site visits starting from fiscal year. DOL, USCIS, and DOS are sharing each every information about you, so any misinformation will backfire you.

2016 Feb 4 th week Stamping /visa extension .
2016 Mar 3 rd week i had a officer coming at work location ask about my client , pay ,role and how i report about work .

I was working from home then and later he came again to take the pics at my cube . He informed me that its a random check . If he needs any documents and told me that he will keep in touch if not i can carry on with my life.

2016 4th week he did ask (email)few documents passport pages , pay stubs very basic .

2016 apr 1st i told him that i travelling to india and asked if its okay , he informed there is no hardcore receipt for this query . i can move on with my life .

i have visa until 2018 June .... now waiting refile again . am with the same client since dec 2015 . Hope this helps please let me know about your extension exp or anything i need to consider .

Try to answer only to what he asks , do not try anything out of the box. Keep the conversation simple.

Since client Role is not Documented ,you can tell the role as you have in LCA.Also have a word with employer /Imm Lawyer

Please ensure you answers as simple as possible . If he needs any further Documentation am sure he will reach out to you . If not you can forget about this and move on .

My experience after this check was positive at the POE , they never asked me anything during my many travels .hope this helps

It will not be a problem if it doesn't deviate much from your LCA. Like in you LCA you said, senior developer, but at client place you are lead/or module lead, that should be fine. But if you work as simple resource manager or project manager, then LCA needs to be updated or h1b should be amended properly. Then your day to day activities/responsibilities changes a lot.

How were you reached out? did your front desk tell you that someone has come to visit you? Or did the officer directly call your mobile?

Also when you were contacted, did you tell them that you have been working from home on that day? Did you ask anything like how long have you been working from home etc?

I was working from home and front desk has called me on my cell phone . USCIS officer has left his phone number and asked me to call him back .

I Imm called my employer /Imm lawyer and told about the situation . Then i was aware how the proceedings will be .

i took good 45 mins to prep my self before i called him , had all documents handy during the call .

After all the questions he again came to my office to take the pictures at my cube and asked for( after a week) Pay stubs , W2 in the email.

The pictures records the time and date , Officer will authenticate your location / place of work .

When i called i did tell him that i was working from home on fri . He did ask me how many days in a week you work from off

i replied " i usually work 5 days a week at times i may have to attend early morning meetings when that happens i prefer to work from home "
