Hi, The time which i have mentioned was RFE response time after your employer receive the RFE papers from USCIS (on Name was updated RFE)
Employer will take 2 to 3 months. Check with your employer what USCIS asked and why they can't respond with in two to three weeks on RFE (Name was updated)

I'm sorry but i have to disagree with you again. My status also was Name was updated prior to the RFE status.

I have the RFE copy with me and it is for Ability to Pay. The attorney already has everything they need to send the RFE and i was told by HR on Friday that it should not take more than couple of days at most for the attorney to respond to the RFE.
So, i am not sure how you are getting this 2-3 months reference from.

I am sorry to ask this questions.

Are they shared RFE copy to you? Are you working as independent consultant or MNC company?

The reason why I am asking is..my company never sheared those i-140 details. They will tell what is about RFE. And how long it will take to response in two lines.
sharing i-140 RFE details (which is related to employer ) to employee is a compliance issue. That's what my company HR told me.

Yes, i read it the same day it came to my HR but got a copy only last week. I have it saved on my computer as well as a printed copy with my immigration files.

I am a full time employee working for the same employer since past 4 years.

Just to let you know, MY HR was not that efficient up until few months ago. We got acquiared few months back and now i have a new HR & new attorney. The new attorney even contacted me and shared me what he needed from me as part of documnets requested by USCIS.

thanks guys! just got a call from my aunt, my lawyer got the RFE now and theyre asking for the same thing... like the ability to pay, anyways he told her that he has the papers that they are asking so they will submit it as soon as possible.. thanks for the info guys..

Just an update on my case. The attorney sent a response to my I-140 RFE yesterday and USCIS received it today. The online status now says RFE received. Hoping for an approval soon.

Thanks, i hope to hear something soon. Looks like the general time frame for a decision after submitting to RFE is anywhere from 1 week to 3 weeks or so.

My I-140 got approved yesterday (7/1/16). USCIS had received a response to my RFE on June 24 (Friday). Good luck for your RFE.

hey just wanna ask..what did u do next after it was approved? AoS? because my aunt says we need to file i485 and wait again for it to finish then NVC..im just confused here... some are saying here that after approval of i 140, we can file for advance parole and EAD while waiting for the i485 to finish so i can start working there...

If you are in US, you can file 485 along with application for ead and ap. Ead is 765 and 131 is ap. You also need to submit a g325 for history. You will get ead and ap within 3 months and you can start working or travel outside US with them.

If you are outside US you do consular processing, and then you have to wait for 485 to be approved, before you can enter US. Also, another option is to enter US on niv, and then file for green card.

so for my case, what do u mean by "on niv?" non immigrant visa? like a tourist visa? then ill wait for my 485 to be approved?

Niv means non immigrant visa. You can come to US on b1 or other visa, and then file AOS once you are here. I know a few people who did this.

Keep in mind it takes 3 months to get ead and ap, and you should not leave US before getting the ap.
