I-140 Regular processing time - Texas service center

I had to postpone it to next week (Tuesday) as I only received the copy of my I140 receipt from my lawyer late evening yesterday. I will surely keep you posted.

Received response to SR this morning.

We have received your service request. Our systems indicate that you are not the applicant, petitioner, or attorney of record for the receipt number provided. Therefore, we cannot release any information to you regarding this case.

This is the same response I received when I raised the SR by myself. I asked my lawyer to do so and they said we can expect the reply within 30 days. It has been more than 45 days and no response until now.

Interesting. Is the lawyer assuming that they will start focusing on the case because of the SR and should have response in 30 days time?

I plan to ask the attorney to raise the SR.

Not sure how much of this is true, but I did see one post where the person mentioned in forum that 140 SR can only be raised by attorney but 1-485 can be raised by applicant/petitioner or attorney. I was wondering if that is why we received this response. But again, it doesn't make sense because we are the applicant.

Did you check with your attorney on the next steps now that its been 45 days?

The second part you mentioned about i-140 and i-485 SR is absolutely true. I confirmed this with my lawyer. For i-140, it is application filed by `employer on our behalf`. So it belongs to employer, not us. So we are beneficiary, not applicant .

My lawyer is not taking any steps. However, I have planned to meet the Imm officers at the infopass appt. I am not sure whether it will help or not. I don't think we are the applicant we are the beneficiary. May be if it is for EB2-NIW I140 we will be the applicant. I am not sure though.

I received responses on 2/4 of my SRs
I-140 - We cannot share information with you (as expected)
I-485 (dependent) - As the status of this application is dependent on another primary I-485 application, we do not have any status update at this time - service request closed.

My 2 other SRs are still assigned to office (one for primary applicant and another for dependent).

If anybody in filing concurrently , then you do not need your I140 to be approved . You will get your EAD and AP approved then wait for I 140 approval for moving to 485 approval.

Update:

Employer tried to raise SR after checking with Attorney. Seems like it has to be post 30 days to open another SR. She called USCIS Customer care and was told the same. The agent did say that the status is still 'Pending'.

Hi there,

I think it is all depend on the country that you are coming from. It is very hard to predict the processing time of any Service Center in general. It is all depend on each individual case and the country that you are coming from. Texas service center historically is the quicker one compare to others. My immigration lawyer submitted my EB2-NIW to Texas service center in the middle of July 2017, and it was approved without any RFE in 57 days. We have some people in our research institute that did also apply for EB2-NIW during the same period as I did, and after 3-4 months they are still waiting. Good luck with your approval. Thank you.

Just coming back from the infopass appt. it is of no use at all.
I had questions about two different cases.
My EAD/AP was not delivered to me and asked them to resend it. They said it will take 60 days. I am on the 49th day and no signs of them sending it. So I asked about it and they said I need to wait for 60 days to raise another SR.
My pending i140: they said it is still under processing .
No other information was given to me.

Anybody with pending i-140, traveled to India recently on the AdvanceParole card? Can you please shed some light on how it works? Heard the immigration takes longer and stuff. What sort of question to expect.

My EB1A I140 PP app was sent to TSC. Today I received an email from USCIS stating that my Application was received on Oct 24. However, the USCIS website states that the case was received on Oct 31. Any thoughts on which date to trust?

I traveled on AP ( Not India,but neighbor) . My i-140 and 485 are still pending. It seems like all travelers with AP will be taken to secondary inspection room. The officer called me about 10 minutes later. Asked me if I was carrying big amount of cash. That was it.
So , it took me 10 minutes more than average travelers.
I was traveling through one of the pre-clearance transits.

For me , the major issue was to convince the employee at airport in my country that the AP I had was valid travelers document that permits me to enter USA. My was emergency AP so it was printed in A4 papers. It was kind of distressing at my country's airport to get checked in.

I have an approved advance parole that got missed whiling mailing. I also have a H1B - i797 notice that is approved until 2020. I am planning to visit my country this december for stamping. has anyone got any thoughts about it? Will the stamping be rejected for any reason?

If my understanding is correct, getting the stamping done is not a must when you have AP. (of course you need to get hold of the AP card somehow and request a duplicate one). One just needs to have a AP card.

I have a similar situation, where I have 797 approval doc valid until next Sept. I was planning on re-entering on AP hoping that the I-140 & 485 will likely get approved by then.

So, do we mention and show the AP card when we get to the immigration official or need to explain them that the i have pending applications and have AP and then they will take you to the secondary questioning room?

Which airport in US did you arrive and have POE?

Although my AP has been approved I doubt I will receive that in my hands before I leave the country It has been more than 3 months since it was requested to be resent. So that is the reason I want to go for stamping which also gives me an opportunity to keep my H1B visa valid through the approved date.
