We all also know that Previous version of HR 392 passed the house with 378 yes and only 17 no. 4 years back. It passed the house but Senate never voted for it
HR 170 has just passed the judiciary committee as of now. the Law may still not pass as it is and i feel a lot of amendments will be done before it passes

I think the problem is we are soft targets for immigration hawks - a non-suffering visible minority that is wealthier than the rest of the population, whose gains are perceived to have come at the expense of others, most of us follow a different religion (therefore little to no interaction at churches, social gatherings etc), funny accents, haven't made great inroad when it comes to interracial marriages. It doesn't seem like a huge concern that most of us have American kids and going after us is effectively going after Americans.
So the fact is, we do not come across as sympathetic. Our appeal has to be towards the practical, the bottom line.

Whatever it before, HR 392 has zero chances in passing in the current climate. IV has nothing to give us right now except saying Folks be planned for next hurdle. If the extension is stopped, HR 392 will be no need at some point in time. Indian priority date will be current within couple of years. It's a very smart move actually.

I will always be wary of desi support group. That's why I was recommending using twitter to make your voice heard. Follow Kevin Yoder and give him the credit he deserves. Tweet him support and desi in his area should do fund raising for him or invite him to desi events. Politicians love public adulation.

All said and done, we all have to acknowledge H1B as it is will die soon. Major changess will happen to restrict H1B dependent companies and body shopping. If HR 392 passes and USCIS realizes that they have to process huge number of GCs to Desis then they will start making H1B extension tougher so that people drop from GC queues.

h1B will stay after few tweaks. Tech Companies will Lobby Hard and make sure there demands are fulfilled. Again Any change to H1b has to go via legislation. HR 170 is still in house and would need to be voted to become law and thast the max change H1B will have for time being
6+ year extension has been happening from 18 years as per AC 21. Any change needs another law change. Admin change will get immediate stay and will finally be termed Illegal since these 6+ year extensions are still been done eversince AC21 has passed.
HR 392 Passing will not increase any GC processing. USCIS process 140K GC as of today and will process 140K after HR 392 is passed. Please think.
H1B extension tougher - Yes They can do this by increasing RFE's and Rejections for small reasons. But again they will need to follow Law. department cannot write there own LAW for H1B. If they do so they stand to lose there job if they are asked to appear in senate and house committees if someone complains.

The Problem is Judicial committee is sitting over it and may not put the bill for vote and thus the bill will most likely die.
All Committee currently are in republican control. But we need to explain that to republican that HR 392 will actuall control Immigration for 5-7 years since these people are already in USA

There are specific groups that are working over-time to tell people that the H.R. 392 is the only option left for folks waiting for GCs for over a decade (I have been waiting for 8 years).

Try using your own common sense because if HR 392 is truly our only hope then we are definitely screwed because it is not going anywhere anytime soon. There are folks who want to know if it will pass in Feb or March 2018. Nothing will happen in 2018. An administration that is trying to fix the system, why would it agree to remove per country cap and let us mess up the program for ROW. All 392 is going to do is "India First" by pushing ROW into retrogression.

Supporting Groups has already made it clear to its base that they do not want HR 392 as a stand alone bill but baked into something else. Probably all of us have dialed into these conference calls in the past few months. Anyone who has questioned these folks are bashed and blocked from the group. So which DACA agreement is HR 392 being added to ? There is already an agenda for DACA deal and EB immigration is not part of it (unless it is been done secretly).

At this moment there is a lot of fear mongering going on. Agreed that the coming months are going to be tough for everyone but if you are banking on HR 392, you better be ready for disappointment. Skoposlabs is giving it an 18% chance of ever getting passed. The bill that has only been introduced right now and not passed the House yet.

As new policy/interpretations of AC-21 is rolled out, if you are truly highly skilled and needed by your company, your employer will do the needful to keep you. They will pay to renew your H1B every year (if 3 year extensions are cancelled and we are required to renew every 12 months) or maybe send you to an overseas location etc. If you are just someone who probably should have never come on H1B, you will probably have no options left but to abort.

Imagine is HR 170 gets passed (15% probability by Skoposlabs). More than half of the people waiting for GC will not even qualify to renew their H1B.

Talk to you own employer, the immigration lawyer etc. for your options. Good Luck to everyone.

What a negative picture you have painted? Country cap is very unique to US immigration law which has outlived it’s utility. Trump and GOP want to limit immigration from Islamic countries because they feel that terrorist can come from those countries. I don’t agree with this but that’s what GOP and Trump want to do. Now country cap and diversity visa allows immigration from such countries. Trump tried to put travel ban from certain countries but those bans are contested in courts.

What is the long term solution: put a strict merit based immigration system and remove country cap. It will in no way help desis and will penalize ROW. I am sure there will be lot of restrictions coming for H1B specially targeting H1B dependent employees so that they are unable to extend H1Bs and pursue GCs.

Hr 392 blocked in committee which are Republican majority. I have feeling that mid term election will change all that
Ac21 is already implemented and people are getting extension for 3 year and will getting it. Change will require law change
Hr 170 has 15% chance and he 392 has 18%. They should club these 2 and pass
Companies will outsource jobs which it can others they will pay higher wage. Also remember this is only for exempt category. Non exempt category will still go via Lca and prevelling wage route
Nothing big gonna happen. To me Trump is just trying to keep his audiance happy with news and thus some or the other news every 6 month.minimum chage gona happen

India has 29 states and it's union of these states. Bangladesh and Pakistan would have been India if no partion. So how come bagladesh and India is different and have 7% quota. Per country quota is discriminating specially in employment based gc

First come first serve ....... well there will be no first serve because with 392, we (backlogged Indians) will take almost all the visas numbers for the next 6~8 years plus there will be more who would line up during this period.

Agree that 392 and 170 should be clubbed but the biggest supporter of 372 will not allow that.

The real point is that we need to be rational and understand what is going on. If you go the FB page of the supporter of 392, people are asking stupid question like - "will 392 pass in Feb and March ?" and they are not being told the truth.

A new interpretation on AC21 can pass in 2 weeks (not a new legislation but just admin interpretation of "may" and "shall") but the 392, assuming it gets no resistance anywhere, is not happening during 2018.

On the L visa and EB1C, they have already issued the memo to define the "manager" description. Overall, they are aware of EB1C abuse and will be cleaned with simpler interpretation and enforcement of existing policies.

If nothing else, the minimum salary needs to be bumped. In my opinion, $60K is not the money anyone ways to "Highly Skilled" individual.

Exactly 6-8 years No New Immigration which is what Trump wants. The people in country will get those GC Net Net no Immigration in Eb2 and Eb3.
HR 170 - Companies will lobby tooth and nail and lobby hard to stop it
AC 21 - Rule change - in 2 weeks. Can you please explain the process of rule making. As far as i know it needs to come on federal register and then should be open for impacted parties and people to comment and ask question for 60 days. The Admin has to make change /answer the questions then once implemented then the rule will generally give 30-60 for department to start implementation
Agree - 60K is low should have been inflation adjusted since start. BUT JUST THINK why it was not done at start. Do you think the congress at that time was idiot ? The fact would be that companies would have lobbied hard to me done this way :)
