HR392 should be attached to the great immigration bill that would come in January for DACA, border wall etc.. HR392 can’t go alone on its own. It won’t fly.

100% correct that 392 will never fly alone and IV is aware that.

The DACA deal is going to be too complicated to add another twist in it. You think democrats will let 392 go through ? They are the one's who have been holding legal immigration reform hostage for so many years. They might have given 392 in exchange for DACA but the POTUS already wants the wall and elimination of chain immigration in exchange. Can not see any more room for 392.

IV first wanted 100 co-signers, then 200, then 300, then 400 and then they added $1000 per applicant. What is next ?

Exactly. So we shouldn't stick on to HR 392. Don't even mention it anywhere please. Dear backlogged friends, HR 392 won't bring anything good for us once RAISE act is passed. So we should focus on RAISE act. We need to change our direction to convince congressmen and get some additional clause in RAISE act for the benefit of backlogged people.

No one knows for sure this will work out but bet the post 6th year extension will be eliminated in a similar manner to H4-EAD. You can keep it and use it up but the renewal will not be for 3 years just like the H4-EADs will not be cancelled over-night but they will be allowed to expire.

Even if HR392 is passed what is the guarantee, the president will not veto this bill. Why will they pass a bill which will directly affect their base(more citizenship)? For DACA they are against of giving Citizenship to the recipients. Democrats have least priority about h1b now because they need middle-class voters for 2018 and 2020 presidential elections. we talked to California Senator regarding H4 EAD and H1b, she gave a generic answer but sounds her priority is different now, not legal immigrants especially h1bs. At this time we need be united to fight this administration, counter lawsuits.

The G8 bill went through a months of bipartisan negotiations and it died in the House. Any bipartisan legislation will require concessations to the democrats, and there is no way Republicans in super conservative districts vote for it. Immigration may be a hot button issue, but it is not a crisis that Americans think needs fixing.

They cannot eliminate post 6th year extension like what they are doing to H4-EAD. AC21 rule has been passed through congress. They can amend it only with congress approval. That is not an easy task like H4-EAD removal. So don't worry about post 6th year extension now. I am completely worried about RAISE act. RAISE act is going to be the major one as far as immigration is concerned. Definitely they will take it up in congress soon. But still our people are focusing on HR 392. Again I am telling to my dear backlogged friends. HR 392 won't bring any value to us once RAISE act is passed. So don't even mention HR 392 anywhere. RAISE act is not going to pass, no Democrat will support limiting legal immigration and you need 9 senators to vote for this to become a law. even there are tons of Republican Senators opposing reduction in legal immigration. Cotton is a junior senator and he is using this bill to appeal to the base for running for POTUS in future.

My dear friend before couple of months people were same confident with H4EAD but its going. So don't be so much optimistic. Bottom line is any thing can be happen. Writing new rule and withdrawing existing rules are job of govt and its all depends on current situation. H1b is just 25 yrs old concept. It can be restricted once the objectives are meet. They started H1b because they need high skilled professional badly but now they have a lot of H1b waiting for GC and citizenship. Getting new Job/project on H1b is very tough these days because lot of people on bench.

H1b is temp visa. Staying 70 years on h1b is not temp. It's permanent. So, extensions don't meet the purpose, only for Indians. The only way to make it temp is to get GC in a reasonable time and hr392 is the only game in town for that.

Call your senators and congressmen. Doesn't cost a thing.

They used similar logic to kick out Haitians on tps.

Coming on H1B into this country does not give us an automatic right to a GC. The only right we have is the right to enter our country of Citizenship - India (in my case). Everything else is a privilege.

Already fed up by calling lawmakers. Call, call..I am hearing this for almost 2 years. Nothing changed. I have no hope on HR 392. That is a closed chapter. I feel even Americans go against us whenever they hear about HR 392. I would like to believe at least for my comfort that they will amend RAISE act in some level for the benefit of backlogged people.

HR 170 has got NASSCOM's attention. They believe that 170 has a stronger chance of getting passed in an amended state. Pushing min salary to $100K will clean up a lot of the BS and to a great extend take care of the backlog. Of course, if I make leas than the minimum proposed salary in HR 170, my best bet is "hoping" HR 392 passes. Of course, just the way it does not cost to call senator (I agree with EB24life here), it does not cost anything to hope.

You all are thinking too much. US will change immigration system to benefit US citizens. I am sure that in current world US would like to have a immigration system to increase English speaking + STEM graduates/professionals to maintain the lead in advance tech and high tech industries. I don't think as of now US feels that her goal is to be most diverse nation on planet no matter what the cost is. Time for merit based immigration has come. People can say what they feel but this is the consensus building in US and also because most of the developed nations are also implementing merit based system.

Merit based system does help Indians because we speak English and produce enough STEM graduates but no way US will not implement merit based immigration because it may help Desis and keep out people from other countries. US will put a merit based system only for her benefits.

Trump rescinded DACA for reason. GOP already agrees on ending or limiting chain migration and removing diversity visa. Heck even Democrats want to remove diversity visa. These major changes will trigger implementation of merit based immigration. DACA will trigger legal immigration reform which will cut legal immigration and implement merit based immigration reform.

Only open question is what to do with desi people stuck in GC queue:
Looking at current anti-immigration sentiments, I feel H1B rules will be changed to add salary cap and remove body shopping, GOP and Democrats agree on both points, so that future H1 extension will be super tough for people working with desi consulting companies with approved I140. GC queue will be shortened by implementing such measures.

Lot of republicans have some kind of immigration reform ready with them. GOP will pick any of them and will work to implement it with DACA. Similar to what GOP did with Obamacare repeal.

HR 392 does not increases any Immigration. INFACT it reduces that for at Least 5 years. Since h1B people are already here and no new Immigration will happen. PLEASE STOP SAYING IT WILL INCREASES IMMIGRATION

Trump withdraw DACA because he wanted 1) Illegal immigrants deported or 2) Funding for border security and THE WALL. So that one of his election manifesto is completed. At heart he know that Congress may end up doing nothing if he and republican wan to stall it in congress and thus i Feel DREaMERs are in huge trouble since trump may start demanding things which will never be fulfilled and thus no Bill will be passed
H4 EAD is in trouble, just like DACA. They can do it based on rule making saying that OBAMA had no authority to grant work permit to H4 dependent
HR 170 - H1B change bill is quite possible this year but i have a feeling that this bill will die under lobby pressure as well
I feel HR 170 should have gone hand with hand with HR 392 but Judicial committee things otherwise
HR 392 - can now be part of DREAM deal since H4 Dreamer wont be resolved only with DREAM act and thus they might add HR 392 to fix the legal H4 dreamers problem

Politically what i feel is that TRUMP is not able to deliver anything on Illegal Immigration on which plank he has won the election.
So now he is trying to deflect the issue to legal and keep the issue hot till mid term.
Mid term election will tell what american think on 1st 2 years of republicans. So just wait and watch
