Current admin is against HR 392 is laughable statement. There is not one statement from anybody opposing HR392.
Current admin is against chain migration and diversity visa because admin feel such system doesn’t add smart and brightest immigrants.
Current admin also feels that immigration system should put premium on people graduating from best American universities or any other best institutions like IITs.

Current admin also want to restrict immigration from certain countries.

So current admin will implement merit based immigration and remove country cap.

Now does this mean it will be easy for all the desi H1B people waiting in GC queue. Answer is NO
Lot of restriction will be put place to drop people on H1B with desi consulting company or H1B dependent companies.

My dear friend before couple of months people were same confident with H4EAD but its going. So don't be so much optimistic. Bottom line is any thing can be happen. Writing new rule and withdrawing existing rules are job of govt and its all depends on current situation. H1b is just 25 yrs old concept. It can be restricted once the objectives are meet. They started H1b because they need high s ed professional badly but now they have a lot of H1b waiting for GC and citizenship. Getting new Job/project on H1b is very tough these days because lot of people on bench.

to ToughTime4H1b:

I knew from day one of this admin that H4EAD will go away as Jeff Session is not going to defend it in the court(he opposed it as Senator during Obama admin) and it's enacted through rule making so easy to rescind. but passing RAISE in current form is not going to happen. anything limiting legal immigration and needs legislative changes is not going to happen. even I doubt DV will go away due to african american caucus forget about RAISE act.

No one is supporting Diversity visa. No one. Plain and simple.
Infact poor black and Latino suffer more due to low skill migration.

Congressman Kevin Yoder shared this on twitter:

https://yoder.congressnewsletter.net/common/mail...

Read point 3. He is still committed to HR392 and talking about it.

Move your lazy bum and like and follow him on twitter.

Please laugh if you want to. But this administration is against any kind of immigration - legal/illegal. Their primary aim is to reduce immigration in all forms. If you do not realize this from all the signals coming out of the hill, then I don't know what to say.

That is right. The probability of HR 392 to pass is absolutely zero. But there is going to be political will for RAISE act I see. We have to focus on RAISE act.

Honestly, I don't think you understand how law making works. Collecting co sponser means squat. How many co sponsors you think DT had to collect before the tax bill came up for voting? Let me answer - zilch. Zero. If the leadership wants to pass a bill, they will work behind the doors, and get it done. If a bill has no political will ( like 392), it will just bite dust and die at the end of Congress.

to eb2gcdreamz:

well said.

But, people like IV are mis guiding people and filling people with false hopes to collect donations.

sad. but true.

and people want to live in their bubble with denial.

some day, they will realize the harsh truth. and that day is not far. very very close.

Read this in times of India. Is this true? We all have to go back now? Or is this just an exaggeration?

Indian Media has no understanding of h1b visa or American Immigration laws. They are all over the place with fact and figure. 50-75 K . God knows where they got that number from.
FEAR MONGERING

Agree.

All this is coming from one source - IV. Not saying it is false but this sense of chaos is being created by them. McClatchy and Hindustan times are both from IV.

This BS about mass deportation is all coming from the leader of IV. If you listen to his conference call, you can see the fear mongering. Try questioning him on his FB group ... he will say something stupid and then block you. Then his followers will ask you to reply and why have you now run away .... probably without realizing that you have been blocked from posting.

I am not sure if news about removing H1 extn after 6 years even with approved I140 is true or not but any immigration change to make employment visa country neutral will have lot of ifs and buts.

It may be possible that H1b program is replaced with point based system to make it is easy for USCIS to adjudicate future employment based petition. Proving High skill on paper is very subjective in current H1B process and hence heavy involvement of lawyers.

Also major US politicians now understood H1B program and are aware that H1B lottery is not a best way to distribute H1Bs and also current H1B treats PHD graduate and QA resource equally.

H1B system is also overwhelmed by Indian IT Consulting firm. I will not say they abuse it but current H1B system is such that Desi companies bring IT testers on-site on H1B forget junior IT developers.

I know that we indians tend to be pessimistic but there is clear desire by US politicians to reform US immigration system. It has been consistently tried but always failed because Democrats want something for illegal aliens in any immigration reform bill.

Trump just to put his name on a immigration legislation is going to do a legal immigration reform this year. He knows that infrastructure and legal immigration reform has no opposition.

Thats why even in my past post i suggested H1B folks to try to find an non-H1B employer with atleast $100+ salary. Beware, HR392 or any reform will not provide blanket help to everybody in GC queue.

Well said IMMITALK.

or if someone is really required for the job, the employer will figure out a way or will be ready to pay for annual H1B extension beyond 6th year.

Guys, highly recommend reading perchingtrees latest artcile on h1b overreaction that he posted today. Keep in mind he is not a lawyer and rightly predicted immigration changes(h1b scrutiny, h4 ead, opt etc) last year in January with tones of facts and analysis.

Just saw Vice News piece on GC backlog for Desi H1b People. Few takeaways:

Kevin Yoder is one of the most conservative GOP politician. Hillary won in his district so to be politically relevant he is promoting HR#392 and he also feels that all the desis getting GC and eventually citizenship due to GOP immigration reform can become GOP voters and help GOP to counter anti-immigration rhetoric. Kevin Yoder is working on HR392 also to help him keep his seat in long term so that he can achieve higher political goals.

So GOP is not helping desis without any reason. Also Shalabh Kumar's joining forces with Trump means that GOP and Trump feels that they can count on Hindu-Americans, till now democratic voters, votes in future elections. Also desi-community can contribute a lot during elections.

Desis, don't feel disheartened. In the end it is all about politics and GOP politicians see desis as their new voting blocks to increase their base.

Add more power to Kevin Yoder. He can surely get things done as he is as conservative as Republicans can be.

They need to bring legislation for changes in h1b or GC. Otherwise as I have said earlier it will need challenged in court and very badly defeated. They have no data or points to defend. All these years DOL and USCIS has been giving 6+ year extension. They can't take u turn just because someone wants it that way
