I am not sure you understand the situation. They won't deny mass applications, everything is case by case and they give only 1-year extension(which already they are doing from last 2-3 years). How many times anyone file 1-year extension, In the worst case they have to file 10 times every year.

The system is so messed up that they knew each and every loophole. Don't underestimate.

You are right.

This is going to force employers to re-evaluate their strategy. Spend on H1B extension once in 3 years and 3 times in 3 years. We are talking about serious money once you include the lawyers fee .... plus if the minimum H1B salary goes to $100K ??? You got the point.

I am sure there is something going in. There is no smoke without fire.

Today Trump again tweeted about DACA. I think major work is going on immigration side and i don't think DHS or USCIS is going to bring these changes. I feel USCIS must have informed that many people are waiting in GC queue and before moving to new system they need to complete the backlogged GC. Now they are trying to find out how to cut short that backlogged.

This is my gut feeling that, Attorney General discretion and "may be" clause will be used to filter out people specially earning low wages on H1B or working with desi consulting companies. Trump and GOP always hated desi consulting firms.

yes, seems to me that they are going to come out with a "comprehensive" immigration bill soon in senate, which would cover :
1. diversity visa (gone)
2. family based (move to point based)
3. employment based (move to point based)
4. daca (safe - to get democrats vote)

Guys: any one knows how to get a thread closed/deleted.

This HR392 thread should go away. Come on guys: we are not sure if H1B extension would survive and we are discussing HR392. Have we really lost our senses?

PS: please don't attack free speech. Help me get this thread closed. We can re-open when HR392 is introduced in house/senate.

agreed ..there will not be an explicit blanket ban of 6 years + extension ..how ever extension will be tough going fwd and rejections will be really high ..and they will use specialty occupation clause, wages and this "AC21 May" BS to deny applications ..
and every one will be happy then ..and th ebacklash will be less

:) they are not able to process the current visa applications. They take 6-8 month to do it.
If they make it 1 year extension then after you apply they will take up your case after 1 year :)
So be practical in saying applying 10 times a year since this is not possiable

the processing time is high for low/middling wage applications from dependent companies, people with > level 4 wages from non h1b dependent companies are getting there h1b approved in a month or two,

Trump has done coalition with Hindu community during election and TRUMP has said that he likes people from INDIA.
its "Ma be' not sure why you guys are reading it as 'Should not'. The idea of AC 21 was to give 6+ year extension otherwise they would not have included that part at all:)
May be is for specific they cannot say will be since that will impact H1B rules and thus may be and not should be.
Just 1 line answer you give me - Does USCIS has given 6+ year extension or not ? What was the purpose of AC 21?
Dont twist the word and create Panic.
Attorney general has no business to see wage and deny on that. The wage part is DOL stuff and they are doing prevailing wage for job defined in your LCA

I mean once a year. 10 times in 10 years. I should have been more clear. in fact, the first one who replied understand that.

They will welcome one time a year even it takes a year to process it as there is a lot of money involved in it.

End of the day, they can make our lives as hard as it can be.

nothing is gonna happen with AC21 based H1 extensions. worst case they will just grant 1 years extension. Trump will be just one time president even if he survives any impeachment efforts. next admin is going to rollback all of this nuisance. even any other republican president will allow limitation in high skilled immigration. for most of use it is going to be one time pain. India will be 5th largest GDP in couple of years and US will want to grow its alliance with India.
at least house if not Senate is going to flip in Nov, Trump nemesis Romney is going to win Utah election. more trouble for this admin in future. they will have to spent lots of political capital on that. after lottery process improvements and other tough h1 measure they will declare victory and Trump will tell his base that he has taken care of H1 issues.

i have said what i have too. What i do agree is that the climate is changing and becoming Bad for immigrants since people will be divided and this hate will come on day to day life and interaction between brown Black and White skin people. There have been some killings which have happened early this year and i fear this uncalled divide is increasing due to propaganda.
H1b - worst case will be going back to India. But the bad news is for indian with GC and Citizenship since this hate against a community will not look at GC and Passport before attacking someone with color.
I hope this bad and wrong divide which is being created against Desi population is stopped

also Even if no change is done the biggest problem i am seeing is mental health of Indian community :)

may be ..but the cases I'm talking happened this summer may, june, july .. when uscis processing times were 9 - 12 months and premium processing was suspended ..processing is definitely faster for high wage/non h1b dependent petitions ..

exactly. Once hatred spreads,GC and Citizenship does not matter - all Indians will be treated the same... I really wish Obama had done a good job with the H-1B/GC system by changing the system carefully. He could have done with a lot of thought unlike Trump.

Yes we are from India . If you are not then what are you doing here?
Are you saying that there are no murder happening in USA?
Are you saying that there is no black vs white divide in USA? If not how was Trump elected?
Are you saying that there is no North vs south divide in USA?
Are you saying that the capitalistic company owners are not discriminating toward middle and lower income group in USA?
I am aN indian but that does not hide the fact that the same happens at much larger scale in a developed country called america.
Think about it buddy

It was not Obama problem. It's a Congress problem. Obama said that if Congress pass comprehensive immigration reform which was approved by gang of 8 then he will happily sign it
But congress did not pass it and thus he did executive action in Nov 2014 to push congress and they still did not do anything and thus I say don't compare immigration bill to tax bill or any other bill. People in congress don't care about it and changing any thing in it is like climbing Mt Everest
