9940 is in place of 7.1% of worldwide for EB4 and EB5 numbers. I don't see anything changing about country limits. There will be an increase of visas for each of EB1, EB2 and EB3 category from 40,040 to 58,373, we may get good amount of spill over.

Current Allocations for EB based GC
140000 *28.6% = 40040 GC for each category (Eb1/2/3)

Per country is 7.1% ~ 2843 in each category per year + Spill over

So Indian max can get 2843*3=8529 (for Eb1+2+3) +Spillover

Proposed Allocations under this bill for EB based GC

Will be 58373 for each category (Eb1/2/3)

Per country be 9940 in each category + Spill over

So Indian max can get 9940*3=29820 (for Eb1+2+3) +Spillover

Per country limit is 7% not 7.1%. The 7.1% in there is for EB4 and EB5 numbers that is 9940 (i.e 7.1% of 140,00). The proposed bill is not increasing that number for EB4 and EB5. They are splitting the additional 55,000 numbers to EB1, EB2 and EB3 only, that is a good thing. So each of this category will receive 18,333 additional. India will get 7% of 195,000 for all of EB categories (EB1,EB2,EB3,EB4 and EB5) + spillover as per the spillover rules.

45000 extra GCs followed by hr170 that will clear up GC backlogs. Uscis hasn’t wasted any GCs from 2007 or so. This is a good thing for us.

I think the per-country limit is for overall number not per category. We cannot actually tell how much in each category as India always get more than 7% in each of the category. Take Philippines as an example, their EB1 numbers are below 7% and EB3 numbers are above 7% each year but their overall numbers will not exceed 7%. It is my understanding, I may be wrong.

The summer you are referring there, increase from 120,000 to 175,000 is for EB1,Eb2 and EB3 only, it did not include EB4 and EB5.

EB1C abuse happens due to legal loopholes which are used due to backlog issue. why would any company exploit loophole and file EB1C if they know they can get EB2/3 at same speed right way?

Getting rid of country quota is only way to stop EB1C abuse.

India already gets ROW spillover so Spill over from EB2/3 ROW equation is not changed significantly per this bill.
