Goodlatte bill is making provision for DACA folks to renew every 3 years. and then they can pursue other routes to GC (EB or family based) which I think is the fair way to do it rather than just hand over backdoor GC's to these folks.
So in that sense its a fair bill to all.
but no hopes of passing.. if it passes it'll be a miracle.

Does this mean that for e.g EB2 India quota will increase from 2800/ year to 9940/ year if so then its a good deal for us

People is DACA status just want that their status somehow becomes legal, after that i am sure they will all marry an american citizen to pursue their GC. DACA people will not have tough time in getting marriage based GC.

They are unable to pursue marriage based GC right now as their status is illegal in US.

to JUSLOOKIN:

So it seems that instead of 2800/ year for EB2 India we will get approx 4140/ year for Eb2 India .... not huge increase but beggars are not choosers so we will take what we get... something is always better than nothing ....

Hopefully they crackdown on EB1C also and all the negative publicity reduces the eb-row applications

I see so much of ranting here from our most rational desi community on Goodlatte Bill. What is that they should have done, just clear all the GC queue. Use some sense guys, you won't get everything that you want from your parents, wife and even kids. I have been following Mr. Goodlatte for over 5 years, he is a very rational man and a great soul with all respect to the educated folks, and most of all a patriot by nature.

Given the circumstances where Dems want DACA and President being adamant on Border Wall, what best could have been achieved. Keep in mind that they cannot disappoint corporations that pay taxes, and they cannot disappoint vote bank either. The current solution is a mid path that does not affect anyone.

Coming to increase in number of EB GC, the current 140K itself are not completely filled by ROW and there have been spillovers to India EB. But as you all know most of the EBs are consumed by EB1C from these WITCH companies, if that continues, EB2/3 India will never move. But look at the beauty here and use brains, with elimination of lottery salary takes the precedence. Number of WITCH applications will go down. With these two steps, available count should significantly go up for EB2/3 India/China.

You can't get the whole earth in a single day, please be reasonable and appreciate the bill. I am for it, initially I hated Trump, but I believe he is doing the best for Indians than Democrats.

If 50k GC are increased will the dates move to 2011 or 2012 ?

to gcforevergc:

It purely depends, if the DACA folks in Skilled Category and can apply in EB2/3 category dates may not move at all as their numbers are higher. Also if the current flow of EB1 category for India stays as is then also you won't see a change in dates, too early to comment on anything.

But most of the DACA may not fall in Skilled category and hence they kept this rule. Most of the DACA folks do blue collar jobs and getting the sponsorship for them may be difficult. This is another way they are trying to send them out. Since 800,000 is a big number and they get additional 3 years to get into any of the categories, it is difficult to make a prediction.

On a funny note our desi community may rant if the number of EB2/3 applications go up from these folks, keep watching.

Reposting Post # 68 from Incore (with corrected worldwide numbers):

Numerical Worldwide Limit for EB New = 195000 let's call it EBWLN (new) and the old limit at EB as EBWLO (140,000)
-----------------------------------------
Worldwide-EB4New=Religious/Ministers=7.1% of EBWLO (Hard capped at 9940 by Goodlatte)
Worldwide-EB5New=9940 by Goodlatte
Worldwide-EB1New=58,374 + Spillover/Unused from EB4New/EB5New (earlier this number was 28.6% or ~40040 +Spillover)
Worldwide-EB2New=58,374 + Spillover/Unused from EB1New (earlier this number was 28.6% or ~40040 +Spillover)
Worldwide-EB3New=58,374 + Spillover/Unused from EB2New (earlier this number was 28.6% or ~40040 +Spillover)

The annual worldwide level for All categories of permanent immigration is 675,000 LPRs
INA establishes per-country levels, or country caps, at 7% of the worldwide level in categories other than EB.

Which means Guaranteed ~18693 more Green cards in each category per Year.to each EB1/2/3 category for India, It will be good unless EB1C eats it all

No Spill over to India once DACA people started applying in Employment based Greed card as per Goodlatte bill, if HR392 does not pass, Senate bill is not providing 55000 diversity green cards to employment based.

We will be in Green card back logs for decades, Nothing will be done till we protest like DACA people

yes thats what I was saying , from the numbers posted above EB2New = 58,374 so EB2New - India = 7.1% of 58,374 = 4144 instead of 2800

At this rate, deal looks difficult. Lets see how they negotiate. It would have been good if HR392 was at least on the table for discussions, but looks like might not be the case.

to fintechguy:

Goodlatte is the head of house judiciary committee which is where HR392 is in, and he has not considered it (the 7% limit remains). But looks he has done good in other ways (looking at the calculations folks have done).

Historically, can you tell me (the year) when India got (or used) ONLY 2800 GC's? The point you are missing is the SO.

The bulk of the increase is going to go towards India and China helping clear backlog.

We need to take what we get (as increase) as it does only good and no harm. Yes, we can always hope for more.

On a side note, I know there are people who want the cake (increase in GC limit), The Icing (Lateral SO) & eat it too (Vertical SO) - If not, go all out abusing folks under the charade of anonymity.

What makes you think they (DACA Recipients) are going to follow EB?

They have to register and will get temporary & conditional residency (this is what everyone is crying as amnesty). Once they satisfy the conditions of the residency, they will be eligible to naturalize.

The term of conditional residency is like 5 years or so.

guys...if u follow the series of events closely.....this is how DACA is shaping up

Group 1) Goodlatte and co (Conservative republicans) : They are only republicans working and pushing this bill to trump. This has at least some peanuts for desis stuck in backlog as they want to give the DV lottery # to EB queue
Group 2) Jeff flake and co (liberal republican + ultra liberal democrats): This has both replicans and democrats aka bipartisan bill. They wanna screw desis yet again. Take the 50k and give it to TPS folks...aka more latinos.

The media is cheering for Group 2 already.....i highly doubt anyone will take Goodlatte bill seriously.....wishful thinking!

I really hope they do something for backlogs .... Dems just want to show that they are helping Latinos and don't care for legal backlogs ..... if they had a choice they would allow entire countries to migrate to USA so they could get votes ..... GOP may not be immigrant friendly but atleast they prefer skilled ppl as compared to the low skilled refugees or chain migration that comes from South America

This is just not going to solve the Backlog problem in anyway. Its unnecessary to even talk about it
