Today I received the receipts for my wife's I485. I noticed that the priority date printed is from her I140/EB2 (June 2011). This is not my PD (Oct 2006). We used the A# which was assigned when her I140 was approved in EB2 from her company.

Is this an issue?

Yes, that might be an issue. However, they should have rejected if it was filed with PD of June 2011, so maybe the system has your PD assigned- not sure?

I suggest that you talk to USCIS to get this corrected with your PD or make sure that the case is processed as derivative with your PD.

When the I485 form was submitted it mentioned it was a derivative application and had my I-140 number. Do they reject it immediately if the PD is not current or would generate a receipt?

The receipt says that if a priority date is printed it does not reflect the earlier retained PD.

Do they reject it immediately if the PD is not current or would generate a receipt?

Yes they should not have accepted the application/generated receipt if wrong PD was used but i have heard cases where they rejected it a bit later.. with USCIS you never know and they do not take responsibility for their actions.

It does not hurt to confirm that the case is processed with the correct PD, since the PD is incorrect on the receipt notice.

Thats what I am worried about, if they reject it later. How long did it take to get biometric appointment.

I will call them on Monday and also check with my lawyer. But the lawyer they just say based on their best guess.
The case number is not searchable on USCIS website. The problem is getting to an L2 officer who can see the information.

My wife had her RD as the PD. When I pointed this out to the attorney, they said this must be a USCIS error and we should talk to them to fix it. However, my wife didn’t talk to a L2 officer yet. I have. Noticed few others who has a similar PD like this. One of them is going for an interview and I hope they will be able to ask about this anomaly.

You definitely should take an infopass or talk to a L2 Officer

Yes. She did the interview. I wrote about the experiences in this forum. Also, we received her EAD /Parole combo card. Interestingly, the Combo card is valid only for one year.

Did calling and talking to the L2 officer help? How did you get it corrected? I am sure my lawyer will just give it a pass saying its a non issue.

I guess since she was assigned an A# which was associated to her I140, it picked up the date from her EB2 PD. Scared if they deny the application based on this.

My wife's ead/ap is also for 1yr. Maybe because the pd is current.

The lawyers created an SR to get correct this today. So have to wait and see.

My Husband just got over his interview, he was dependent and he went alone, the officer asked him about his first date to entry to USA and last date of entry, asked him about his pending I-140s, my employment verification letter, about his present employment birth certificate marriage certificate, the interview as quick just lasted 15mins or so, at the end he said everything looks good and he should get a response in 120days, but he said he might get a final decision much sooner too, but they say 120 days as that is standard time frame.

My lawyers told me to not call USCIS for the case, since they are handling the case, and wait for the SR response.

How long did it take to get bio metrics appointment letter? Also the case status website does not recognize the receipt number, so basically I am in the dark right now.
